Abstract

Marriage for the Toba Batak people is an institution that does not only bind a man and a woman, but also binds the two extended families. The binding of the two extended families through a marriage has implications for the formation of a new Dalihan Na Tolu as well. Dalihan Na Tolu must be present and consulted to carry out his rights and obligations according to his custom. One of the rights and obligations in question is the provision of Sinamot. Sinamot or tuhor ni boru itself is a marriage payment in the form of money given by the man to the woman as an initial sign of forming a family in the traditional Toba Batak culture. The sinamot that has been given by the man to the woman will then be used to finance party equipment. It can be seen that the nominal cinnamot will affect the size of the party that can be held later. The existence of the synamot itself cannot be separated from problems of social status and prestige among families. This study uses the Theory of Justice and Legal Benefits. The purpose of this study was to find out the relevance of the size of the sinamot to Batak Toba marriages in the Tangerang area and the legal consequences of the size of the sinamot proposed by women in Batak Toba marriages in terms of Batak Toba customary law and Law Number 1 of 1974 concerning Marriage. The method used by the author is Juridical Empirical Sociology. Data collection was carried out by interviewing the primary data and studying the literature for the secondary data. The results of this study are the result of the large sinamot proposed by the women causing delays in traditional marriages, and also cancellation of marriages. The author suggests that with the development of the times, sinamot should not become an obstacle for Batak Toba couples who want to carry out traditional marriages, so that unwanted things do not occur.

Additional Information:	Perkawinan bagi masyarakat Batak Toba merupakan sebuah pranata yang tidak hanya mengikat seorang laki-laki dan seorang perempuan, namun pula mengikat kedua keluarga besar. Diikatnya kedua keluarga besar tersebut melalui sebuah perkawinan berimplikasi pada terbentuknya satu Dalihan Na Tolu yang baru juga. Dalihan Na Tolu harus hadir dan berembuk untuk menjalankan hak dan kewajiban sesuai adatnya. Salah satu hak dan kewajiban yang dimaksud ialah pemberian Sinamot. Sinamot atau tuhor ni boru ini sendiri merupakan pembayaran perkawinan dalam bentuk uang yang diberikan pihak laki-laki kepada pihak perempuan sebagai tanda awal dari pembentukan keluarga dalam budaya adat Batak Toba. Adapun sinamot yang telah diberikan oleh pihak laki-laki kepada pihak perempuan kemudian akan dipergunakan untuk membiayai perlengkapan pesta. Terlihat bahwa nominal sinamot akan mempengaruhi seberapa besarnya pesta yang dapat digelar nantinya. Keberadaan sinamot itu sendiri tidak dapat lepas dari masalah-masalah status sosial maupun gengsi antar keluarga. Penelitian ini menggunakan Teori Keadilan dan Kemanfaatan Hukum. Adapun tujuan penelitian ini adalah untuk mengetahui relevansi besaran sinamot terhadap perkawinan Batak Toba di wilayah Tangerang dan akibat hukum besarnya sinamot yang diajukan oleh pihak perempuan dalam perkawinan Batak Toba ditinjau menurut hukum adat Batak Toba dan Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan. Metode yang digunakan penulis adalah Yuridis Empiris Sosiologis. Pengumpulan data dilakukan dengan wawancara untuk data primer dan studi literatur untuk data sekundernya. Hasil penelitian ini adalah akibat dari besarnya sinamot yang diajukan oleh pihak perempuan menyebabkan penundaan perkawinan adat, dan juga pembatalan perkawinan. Penulis menyarankan bahwa dengan adanya perkembangan zaman, hendaknya sinamot tidak menjadi halangan bagi pasangan Batak Toba yang ingin melaksanakan perkawinan adat, sehingga tidak terjadi hal yang tidak diinginkan.
