Abstract
Forensic medicine is the use of medical science aimed at determining the relationship between an act and the consequences that will result from that act, whether resulting in injuries to the body, health problems, or causing the death of a person, where the consequences are suspected to have occurred. Based on the background of this problem, the problem studied in this research is how the role of forensic medicine is to determine the cause of death of the victims of 6 FPI members in terms of evidentiary theory (Putusan Study Number 867/Pid.B/2021/PN.Jkt.Sel) and how the verdict is released. judge to police officers who committed the criminal act of murder of 6 FPI members in terms of the judge's theory of consideration (Putusan Study Number 867/Pid.B/2021/PN.Jkt.Sel). This research uses the theory of evidence and the theory of judge's consideration. As well as qualitative research methods using a juridical-normative approach. Using secondary data sources, consisting of primary, secondary and tertiary legal materials, data collection techniques using library research. The results of this research are the basis for the Public Prosecutor's indictment in the form of Forensic Expert Statement, VeR, Autopsy and ballistics as clues. The public prosecutor charged the defendant with the primary indictment of Article 338 in conjunction with Article 55 paragraph (1) 1 of the Criminal Code for Murder but the judge decided to let the defendant go and deemed it a forced defense. The judge, in deciding the case, ignored juridical and non-juridical factors and only based on the defendant's statement, and did not examine the results of the forensic medical examination. The judge did not examine further the elements of forced defense, the elements of forced defense based on Article 49 paragraph (1) of the Criminal Code, the various types of forced defense, the requirements for self-defense, especially the principles that apply in forced defense, namely the Principles Subsidiarity, the Principle of Proportionality, and the Principle of Culpa In Causa, which were not fully fulfilled in the murder case of 6 FPI members.

| Additional Information: | Kedokteran forensik adalah penggunaan ilmu kedokteran bertujuan untuk menentukan hubungan antara suatu perbuatan dengan akibat yang akan ditimbulkan dari perbuatan tersebut, baik yang menimbulkan akibat luka pada tubuh, gangguan kesehatan, atau yang menimbulkan matinya seseorang, dimana terdapat akibat tersebut diduga telah terjadi tindak pidana. Berdasarkan latar belakang masalah tersebut permasalahan yang dikaji dalam penelitian ini adalah bagaimana peranan kedokteran forensik untuk mengetahui penyebab kematian korban 6 Anggota FPI ditinjau dari teori pembuktian (Studi Putusan Nomor 867/Pid.B/2021/PN.Jkt.Sel) dan bagaimana putusan lepas hakim kepada anggota polisi yang melakukan tindak pidana pembunuhan terhadap 6 anggota FPI ditinjau dari teori pertimbangan hakim (Studi Putusan Nomor 867/Pid.B/2021/PN.Jkt.Sel). Penelitian ini menggunakan teori Pembuktian dan teori Pertimbangan Hakim. Serta metode penelitian kualitatif dengan menggunakan pendekatan yuridis normatif. Menggunakan sumber data sekunder, terdiri dari bahan hukum primer, sekunder, dan tersier, teknik pengumpulan data dengan studi pustaka. Hasil dari penelitian ini adalah yang menjadi dasar dakwaan tuntuan Jaksa Penuntut Umum berupa Keterangan Ahli Forensik, VeR, Otopsi dan balistik sebagai petunjuk. JPU menuntut terdakwa dengan memberikan Dakwaan Primair Pasal 338 jo pasal 55 ayat (1) ke-1 KUHPidana Pembunuhan namun Hakim memutus lepas terdakwa dan di anggap sebagai pembelaan terpaksa. Hakim dalam memutus perkara mengabaikan faktor yuridis dan non yuridis dan hanya berdasarkan keterangan terdakwa saja, dan tidak mengkaji hasil pemeriksaan kedokteran forensik. Hakim tidak mengkaji lebih lanjut mengenai unsur-unsur pembelaan terpaksa, unsur pembelaan terpaksa berdasarkan Pasal 49 ayat (1) Kitab Undang-Undang Hukum Pidana, macam-macam pembelaan terpaksa, syarat-syarat pembelaan diri terkhususnya asas yang berlaku didalam pembelaan terpaksa, yaitu Asas Subsidaritas, Asas Proporsionalitas, dan Asas Culpa In Causa, yang tidak sepenuhnya terpenuhi di dalam kasuspepembunuhan 6 anggota FPI. | |||||||||
