Abstract

Indonesia is one of the developing countries in the world which is carrying out development in all fields, one of which is in the field of law. Every country is no exception, facing the problem of threatening crimes such as violent theft. Violent theft occurs not only due to economic factors but also due to environmental factors. Based on this background, the problem studied in this research is how law enforcement carries out investigations at the Bandar Lampung City Police Criminal Investigation Unit (Polresta) against perpetrators of criminal acts of theft with violence and what factors are the reasons why perpetrators commit criminal acts of theft with violence. in the jurisdiction of the Bandar Lampung City Police (Polresta). This research was conducted using law enforcement theory and the theory of factors that influence law enforcement. As well as a normative juridical research method with a statutory approach and using secondary data sources, consisting of primary legal material, secondary legal material and tertiary legal material with data collection techniques of literature studies and interviews and analyzed qualitatively. The results of this research are that the investigation at the Bandar Lampung City Police Criminal Investigation Unit (Polresta) towards perpetrators of criminal acts of theft with violence was carried out based on Law Number 8 of 1981 concerning the Criminal Procedure Law and Law Number 28 of 1997 concerning the Republic of Indonesia Police. Indonesia, however, in carrying out investigations into criminal acts of theft with violence in the jurisdiction of the Bandar Lampung Police, it has not been carried out optimally because there is still a lot that cannot be revealed, such as evidence where investigators have difficulty finding additional evidence because other items and evidence were taken away by the perpetrator. other. The factors that cause the perpetrator to commit the crime of violent theft in the jurisdiction of the Bandar Lampung City Police (Polresta) are the perpetrator's lack of morals, the perpetrator's environment is not good, the economy of the perpetrator of the crime of violent theft is classified as below the poverty line, the perpetrator's lack of education. and the perpetrator's family.

Setiap Negara tidak terkecuali pasti menghadapi masalah kejahatan yang mengancam seperti pencurian dengan kekerasan. Pencurian dengan kekerasan terjadi bukan hanya factor ekonomi saja tetapi juga karena factor sekitar. Berdasarkan latar belakang tersebut, permasalahan yang dikaji dalam penelitian ini adalah bagaimana penegakan hukum pelaksanaan penyidikan di Reserse Kriminal Kepolisian Resor Kota (Polresta) Bandar Lampung terhadap pelaku tindak pidana pencurian dengan kekerasan dan bagaimana faktor-faktor yang menjadi alasan pelaku melakukan tindak pidana pencurian dengan kekerasan di wilayah hukum Kepolisian Resor Kota (Polresta) Bandar Lampung. Penelitian ini dilakukan dengan menggunakan teori penegakan hukum dan teori faktor-faktor yang mempengaruhi penegakan hukum. Serta metode penelitian yuridis normatif dengan pendekatan perundangundangan dan menggunakan sumber data sekunder, terdiri dari bahan hokum primer, bahan hukum sekunder, dan bahan hukum tersier dengan teknik pengumpulan data studi pustaka dan wawancara serta dianalisis secara kualitatif. Hasil penelitian ini adalah bahwa pelaksanaan penyidikan di Reserse Kriminal Kepolisian Resor Kota (Polresta) Bandar Lampung terhadap pelaku tindak pidana pencurian dengan kekerasan dilakukan berdasarkan Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana dan Undang-Undang Nomor 28 Tahun 1997 tentang Kepolisian Negara Republik Indonesia namun dalam pelaksanaan penyidikan terhadap tindak pidana pencurian dengan kekerasan di wilayah hukum Polresta Bandar Lampung belum dilakukan dengan maksimal karena masih banyak yang belum bisa terungkap seperti barang bukti di mana penyidik kesulitan menemukan barang bukti tambahan karena barang, bukti yang lain di bawa lari pelaku yang lain. Faktor yang menjadi alasan pelaku melakukan tindak pidana pencurian dengan kekerasan di wilayah hukum Kepolisian Resor Kota (Polresta) Bandar Lampung, adalah kurangnya moral pelaku, lingkungan pelaku yang kurang baik, ekonomi pelaku kejahatan pencurian dengan kekerasan tergolong berada di bawah garis kemiskinan, kurangnya pendidikan pelaku dan keluarga pelaku.
