Abstract
Occupational Safety is an effort made to reduce the occurrence of accidents, damage in all forms of loss to humans, equipment, work objects. The problem is First, what is the form of legal protection for health workers in hospitals in improving occupational safety and health? Second, what is the responsibility of the hospital in dealing with health worker problems regarding occupational safety and health? This study uses a normative and empirical juridical method consisting of primary data and secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials and is analyzed qualitatively juridically. The results of this study are as follows: First, legal protection for health workers against OSH is that hospitals are required to provide all facilities and infrastructure related to K3RS and active SMK3RS, K3RS Committee and training for HR on K3RS to prevent PAK and KAK with preventive and promotive, Second, the responsibility of the hospital if there are K3RS problems with health workers, namely the leadership or director of the hospital to be fully responsible both curatively and rehabilitatively and legally both civil and criminal.

| Additional Information: | Tujuan keselamatan kerja adalah untuk mengurangi kemungkinan kecelakaan dan kerugian lainnya terhadap orang, harta benda, dan barang-barang yang digunakan di tempat kerja. Isu pertama adalah bagaimana meningkatkan keselamatan dan kesehatan kerja dengan memberikan perlindungan hukum bagi tenaga medis di rumah sakit. Kewajiban apa yang dimiliki rumah sakit untuk mengatasi masalah kesehatan dan keselamatan di tempat kerja bagi petugas layanan kesehatan. Penelitian ini menggunakan pendekatan yuridis normatif dan empiris serta mengandalkan data primer dan sekunder dari sumber hukum primer, sekunder, dan tersier yang telah dinilai secara kualitatif dari sudut pandang yuridis. Adapun hasil dari Penelitian ini sebagai berikut : Pertama Rumah Sakit wajib menyediakan seluruh prasarana dan sarana yang terkait dengan K3RS, serta SMK3RS yang aktif, Komite K3RS, dan pelatihan sumber daya manusia tentang K3RS untuk mencegah PAK dan KAK secara preventif dan promotif. Inilah perlindungan hukum bagi tenaga kesehatan mengenai K3. Kedua, jika ada persoalan K3RS, maka rumah sakit wajib meminta pertanggungjawaban tenaga kesehatan khususnya pimpinan atau direktur rumah sakit dari segi kuratif dan rehabilitatif maupun secara hukum, baik perdata maupun pidana.. | |||||||||
