Abstract

Cases of criminal acts of hate speech are increasing and many people are caught in the law and eventually go to prison. In fact, it cannot be said that the handling of these crimes has been successfully implemented. On the other hand, other efforts need to be made so that the handling of criminal acts of hate speech can be suppressed so that it is reduced and even no longer violated by society. In the case study of hate speech on social media conducted by Gio Jos against the Tiyuh Panumangan community which was resolved using the mediation settlement method by prioritizing restorative justice, the problem is what are the juridical provisions or legal arrangements penal mediation in resolving hate speech crimes on social media and how the crime of hate speech on social media is seen from the perspective of the principle of freedom of opinion carried out by Gio Jos' Facebook account. This study uses the theory of penal mediation and human rights theory. As well as the method used in solving this problem using normative juridical research methods that originate from library studies. The results of this study are that juridical provisions or penal mediation legal regulations in solving criminal acts of hate speech on social media have not been clearly regulated in the Indonesian legal constitution, but there are a number of rules that provide the basis for settling cases out of court, Gio Jos' Facebook account comments are a form of hate speech, in his comments Gio Jos said Panumangan is an immoral ugly zone where these words have an element of insult but in the perspective of the principle of freedom of opinion that hate speech uttered by Gio Jos' Facebook account is ignorance or negligence in expressing his freedom of expression which is good and right.

Additional Information:	Kasus tindak pidana ujaran kebencian semakin meningkat dan banyak masyarakat yang terjerat hukum dan akhirnya masuk penjara, sebenarnya tidak dapat dikatakan bahwa penanggulangan tindak pidana tersebut telah berhasil dilaksanakan. sebaliknya, perlu dilakukan upaya lain agar penanggulangan tindak pidana ujaran kebencian dapat ditekan hingga berkurang dan bahkan tidak lagi dilanggar oleh masyarakat. Dalam studi kasus tentang ujaran kebencian di media sosial yang dilakukan oleh Gio Jos terhadap masyarakat tiyuh panumangan yang diselesaikan dengan menggunakan metode penyelesaian secara mediasi dengan mengedepankan keadilan restoratif (restorative justice), permasalahannya bagaimana ketentuan yuridis atau pengaturan hukum mediasi penal dalam penyelesaian tindak pidana ujaran kebencian di media sosial dan bagaimana tindak pidana ujaran kebencian di sosial media dilihat dari prespektif asas kebebasan berpendapat yang dilakuakan oleh akun facebook Gio Jos. Penelitian ini menggunakan teori mediasi penal dan teori HAM. Serta Metode yang digunakan dalam penyelesaian permasalahan ini menggunakan metode penelitian yuridis normatif yang bersumber pada studi kepustakaan. Hasil penelitian ini bahwa ketentuan yuridis atau peraturan hukum mediasi penal dalam penyelesaian tindak pidana ujaran kebencian di media sosial belum diatur secara jelas dalam kontitusi hukum Indonesia, tetapi terdapat sejumlah aturan yang memberikan dasar penyelesaian perkara di luar pengadilan, komentar akun Facebook Gio Jos merupakan bentuk dari ujaran kebencian, dalam komentarnya Gio Jos mengatakan Panumangan zona jelek tak bermoral yang dimana kata-kata tersebut memiliki unsur menghina namun dalam prespektif asas kebebasan berpendapat bahwa ujaran kebencian yang diucapkan oleh akun Facebook Gio Jos merupakan ketidaktahuan atau kelalaian dia dalam mengekspresikan kebebasan mengeluarkan pendapat yang baik dan benar.
