Abstract
A beauty clinic is a service center in the field of aesthetic health that was established to provide non-inpatient (outpatient) services that provide services in the medical field which include consultation, examination, treatment and medical procedures and treatment. However, in practice it does not always work as expected, malpractice acts often occur, namely errors or negligence on the part of beauty clinic business actors in carrying out their services. Thus, the authors identify the problem, namely, how is legal protection for victims of malpractice by beauty clinics based on Law no. 8 of 1999 concerning Consumer Protection Juncto Law no. 36 of 2009 concerning Health and how are the responsibilities of business actors towards victims of malpractice by zevmine pure beauty skin care beauty clinics according to Law no. 8 of 1999 concerning Consumer Protection Juncto Law no. 36 of 2009 concerning Health. The theories used are legal protection theory and legal responsibility theory. The research method used is normative juridical, research specifications use a statutory approach, a conceptual approach and a case approach. The data used is secondary data and is supported by primary data and analyzed descriptively qualitatively. The research results show that legal protection for victims of malpractice by beauty clinics has not been implemented optimally and comprehensively. The responsibilities of the Zevmine Pure Beauty Skin Care Beauty Clinic have not been carried out optimally, business actors only provide advice on giving painkillers and neutral injections to the victim's body parts as well as providing material compensation but this has not been fully implemented, there are still many responsibilities that have not been given to the victims malpractice as regulated in Article 4, Article 5, Article 7, Article 8 paragraph (1), Article 29 and Article 30 of Law no. 8 of 1999 concerning Consumer Protection Juncto Article 58 of Law no. 36 of 2009 concerning Health, and the sanctions that can be imposed on business actors are criminal sanctions in the form of imprisonment or fines and administrative sanctions in the form of written warnings or revocation of operational permits. The government, in this case the Health Service, does not hesitate to close beauty clinics that do not have a permit to establish or operate a beauty clinic.

Additional Information: | Klinik kecantikan adalah suatu tempat pelayanan di bidang kesehatan estetika yang didirikan untuk memberikan pelayanan non rawat inap (rawat jalan) yang memberikan pelayanan di bidang medis yang meliputi konsultasi, pemeriksaan, pengobatan serta tindakan maupun penanganan medis. Namun dalam pelaksanaannya tidak selalu berjalan dengan apa yang diharapkan, sering terjadi tindakan malapraktik yaitu adanya tindakan kesalahan atau kelalaian dari pelaku usaha klinik kecantikan dalam menjalankan pelayanannya. Dengan demikian, penulis mengidentifikasi masalah yaitu, bagaimana perlindungan hukum bagi korban malapraktik oleh klinik kecantikan berdasarkan Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen Juncto Undang-Undang No. 36 Tahun 2009 tentang Kesehatan dan bagaimana tanggung jawab dari pelaku usaha terhadap korban malapraktik oleh klinik kecantikan zevmine pure beauty skin care menurut Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen Juncto Undang-Undang No. 36 Tahun 2009 tentang Kesehatan. Teori yang digunakan adalah teori perlindungan hukum dan teori tanggung jawab hukum. Metode penelitian yang digunakan adalah yuridis normatif, spesifikasi penelitian menggunakan pendekatan perundang-undangan (Statute Approach), pendekatan konseptual (Conseptual Approach), dan pendekatan kasus (Case Approach). Data yang digunakan adalah data sekunder dan ditunjang oleh data primer serta dianalisa secara deskriptif kualitatif. Dari hasil penelitian menunjukan bahwa perlindungan hukum bagi korban malapraktik oleh klinik kecantikan belum terlaksana secara optimal dan menyeluruh. Tanggung jawab dari Klinik Kecantikan Zevmine Pure Beauty Skin Care belum dilakukan secara maksimal, pelaku usaha hanya memberikan saran untuk mengkonsumsi obat pereda nyeri dan suntik netral pada bagian tubuh korban serta memberikan ganti rugi secara materil namun belum terlaksana sepenuhnya, masih banyak tanggung jawab yang belum diberikan kepada korban malapraktik sebagaimana diatur dalam Pasal 4, Pasal 5, Pasal 7, Pasal 8 ayat (1), Pasal 29 dan Pasal 30 Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen Juncto Pasal 58 Undang-Undang No. 36 Tahun 2009 tentang Kesehatan, dan adapun sanksi yang dapat dijatuhkan kepada pelaku usaha yaitu sanksi pidana berupa pidana penjara atau denda dan sanksi administratif berupa peringatan tertulis atau pencabutan izin operasional. Pemerintah dalam hal ini Dinas Kesehatan tidak ragu-ragu untuk menutup klinik kecantikan yang tidak mempunyai izin mendirikan sekaligus izin operasional klinik kecantikan. | |||||||||
