Abstract
“Humans in their lives always try to fulfill all their needs. The necessities of life vary greatly, a little or a lot is relative depending on a person's ability or purchasing power. A person's purchasing power is of course greatly influenced by the income earned within a certain period of time after working. As in one of the cases of PT. Lotte Mart Indonesia, in the first instance decision of the panel of judges, rejected the claim for all workers' rights, but at the cassation level, the panel of judges canceled the first instance decision, because the Industrial Relations Court at the Central Jakarta District Court had applied the law incorrectly. The formulation of the problem in this research is how the panel of judges in passing the decision on case number 69/Pdt.Sus-PHI/2020/PN.Jkt.Pst and Decision No. 129 K/Pdt. Sus/PHI/2021 as well as the legal protection and rights that workers get at PT. Lotte Mart Indonesia. This research method uses a normative juridical approach that refers to regulations, case decisions at the Industrial Relations Court No. 69/Pdt.Sus-PHI/2020/PN.Jkt.Pst and Decision No. 129 K/Pdt. Sus/PHI/2021. The results of this study indicate that the settlement of termination of employment, claims for the rights of workers who were laid off by the company, with decisions that are not comprehensive and not in sync between the Labor Law and Decisions at the Industrial Relations Court at the Central Jakarta District Court cause legal uncertainty in the process fulfillment of workers' rights

Additional Information: | “Manusia dalam hidupnya selalu berusaha untuk memenuhi segala kebuuhannya. Kebutuhan hidup sangatlah bervariasi, sedikit atau banyak adalah relative tergantung pada kemapuan atau daya beli seseorang. Daya beli seseorang tentulah sangat dipengaruhi oleh pengasilan yang diperoleh dalam kurun waktu tertentu setelah bekerja. Seperti salah satu kasus PT. Lotte Mart Indonesia yang dalam putusan tingkat pertama majelis hakim menolak gugatan seluruhnya hak pekerja, akan tetapi pada tingkat kasasi, majelis hakim membatalkan putusan tingkat pertama, dikarenakan Pengadilan Hubungan Industrial pada Pengadilan Negeri Jakarta Pusat telah salah Menerapkan Hukum. Rumusan masalah dalam penelitian ini adalah bagaimana majelis hakim dalam memutus perkara putusan nomor 69/Pdt.Sus-PHI/2020/PN.Jkt.Pst dan Putusan No. 129 K/Pdt. Sus/PHI/2021 serta perlindungan hukum dan hak yang didapat pekerja diperusahaan PT. Lotte Mart Indonesia. Metode penelitian ini menggunakan pendekatan yuridis normatif yang mengacu pada peraturan-peraturan, kasus putusan di Pengadilan Hubungan Industrial No. 69/Pdt.Sus-PHI/2020/PN.Jkt.Pst dan Putusan No. 129 K/Pdt. Sus/PHI/2021. Hasil penelitian ini menunjukkan bahwa penyelesaian pemutusan hubungan kerja, tuntutan hak pekerja yang di PHK oleh perusahaan, dengan adanya putusan yang tidak komprehensif dan kurang sinkron antara UndangUndang Ketenagakerjaan dan Putusan di Pengadilan Hubungan Industrial pada Pengadilan Negeri Jakarta Pusat menyebabkan adanya ketidakpastian hukum dalam proses pemenuhan hak-hak pekerja. | |||||||||
