Abstract
STATUS OF RECLAMED LAND AT PT. GANDASARI ENERGY BASED ON LAW NUMBER 6 OF 2023ABOUT THE CREATION OF WORK Generally, pre-reclamation issues are related to licensing issues, which are one-sided legal actions (one-sided will of the government), as well as the issue of reclamation land concession permits, which are two-sided legal actions (government and entrepreneurs). Not infrequently regulatory policies regarding reclamation intersect with each other between the authorities of the central and regional governments. Meanwhile, post-reclamation issues are related to the form of control and ownership of reclamation land, including management rights and land rights obtained from reclamation results. This thesis aims to analyze the licensing authority and status of land reclamation results to the ratification of Law Number 6 of 2023 concerning Job Creation and empirical studies on PT Gandasari Energi. This thesis uses a normative-empirical legal research approach, namely combining applicable norms with data suitability in the field by comprehensively examining legal norms and a case study approach. Data is secondary data and primary data. Data analysis with qualitative analysis. The results of the study show that the reclamation licensing authority at PT Gandasari Energi is based on Law no. 6 of 2023, is the attribution authority owned by 2 (two) stakeholders, namely the Governor who delegates his authority to the head of the Office of Investment and One-Stop Integrated Services (DPMPTSP) of Banten Province and the Ministry of Transportation through concession cooperation with Port operator units (KSOP ) As the authority for port activities that have not been exploited commercially Keywords : Reclamation, land, Undang- Undang Cipta Kerja, PT

GANDASARI ENERGI BERDASARKAN UNDANG-UNDANG NOMOR 6 TAHUN 2023 TENTANG CIPTA KERJA Permasalahan pra reklamasi umumnya adalah terkait masalah perizinan, yang merupakan perbuatan hukum bersegi satu (kehendak satu pihak dari pemerintah), serta masalah izin konsesi lahan reklamasi yang merupakan perbuatan hukum bersegi dua (pemerintah dan pengusaha). Tidak jarang kebijakan pengaturan tentang reklamasi saling beririsan satu sama lain antara kewenangan Pemerintah pusat dan daerah , Sementara itu, permasalahan pasca reklamasi adalah terkait bentuk penguasaan dan kepemilikan tanah reklamasi, termasuk di dalamnya hak pengelolaan dan hak atas tanah yang diperoleh dari hasil reklamasi. Tesis ini bertujuan untuk menganalisis kewenangan perizinan dan status tanah hasil reklamasi terhadap pengesahan Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja dan studi empiris pada PT Gandasari Energi.Tesis ini menggunakan pendekatan penelitian hukum normatif-empiris yakni memadukan antara norma yang berlaku dengan kesesuaian data di lapangan dengan mengkaji norma hukum secara komprehensif serta pendekatan studi kasus. Data adalah data sekunder dan data primer. Analisis data dengan analisis kualitatif. Hasil penelitian menunjukkan bahwa Kewenangan perizinan reklamasi di PT Gandasari Energi berdasarkan Undang-Undang No. 6 Tahun 2023, merupakan kewenangan atribusi yang dimiliki oleh 2(dua) pemangku kepentingan , yakni Gubernur yang mendelegasikan kewenangannya kepada kepala Kantor Dinas Penanaman Modal Dan Pelayanan Terpadu Satu Pintu (DPMPTSP) Provinsi Banten dan Kementerian Perhubungan melalui kerjasama konsesi dengan unit penyelenggara Pelabuhan (KSOP) Sebagai otoritas kegiatan kepelabuhan yang belum diusahakan secara komersial Kata Kunci : Reklamasi, Tanah, Undang-undang Cipta Kerja, PT Ganda | |||||||||
