Abstract

ABSTRACT Discrimination is the difference in treatment of a race, ethnicity, religion, and culture. Donald Trump, who was president of the United States at that time, issued Executive Order 13769 which had the impact of harm and forms of religious discrimination against muslim immigrants who would come to the territory of the United States, especially those from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Based on the background of this problem, the problem studied in this study is how international law regulates discrimination committed by a country and whether Trump Executive Order 13769 is in line with ICERD, using the theory of state sovereignty and the principle of non-discrimination. This research uses normative juridical research methods. This study uses secondary data sources consisting of primary legal materials, secondary legal materials, and tertiary legal materials with data collection techniques using a literature study, analyzed qualitatively. The findings in this research are that some of the contents contained in Executive Order 13769 are not in accordance with Article 2 of the International Convention on the Elimination of All Forms of Racial Discrimination as every country is strictly prohibited from carrying out a form of discrimination and the United States as a party which has ratified this convention can be declared violating and inconsistent with human rights. Therefore, it is necessary for the government to be firm regarding immigrants without any form of discrimination in accordance with international human rights instruments and in accordance with applicable conventions. Detention of immigrants carried out by the United States government should have been stopped, especially immigrants with certain countries. The state should protect citizens and non-citizens in accordance with applicable law and implement ICERD.

Additional Information: ABSTRAK Diskriminasi merupakan perbedaan perlakuan suatu ras, etnis, agama, suku bangsa dan budaya. Donald Trump yang saat itu menjadi presiden Amerika Serikat mengeluarkan Kebijakan Eksekutif 13769 yang memberikan dampak kerugian dan adanya bentuk diskriminasi agama kepada imigran muslim yang akan daatang ke wilayah Amerika Serikat khususnya yang berasal dari Iran, Irak, Libya, Somalia, Sudan, Suriah, dan Yaman. Berdasarkan latar belakang masalah tersebut, permasalahan yang dikaji dalam penelitian ini adalah bagaimana pengaturan hukum internasional terhadap diskriminasi yang dilakukan oleh suatu negara dan apakah Trump Executive Order 13769 telah sesuai dengan ICERD, menggunakan teori kedaulatan negara dan prinsip non diskriminasi. Penelitian ini menggunakan metode penelitian yuridis normatif. Penelitian ini menggunakan sumber data sekunder yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier dengan teknik pengumpulan data secara studi kepustakaan, dianalisis secara analisis kualitatif. Temuan dalam penilitian ini ialah terdapat beberapa isi yang tertuang dalam Kebijakan Eksekutif 13769 tidak sesuai dengan Pasal 2 Konvensi Internasional tentang Penghapusan segala Bentuk Diskriminasi Sosial sebagaimana setiap negara dilarang keras untuk melakukan suatu bentuk diskriminasi dan Amerika Serikat sebagai pihak yang telah meratifikasi konvensi ini dapat dinyatakan melanggar dan tidak sesuai dengan hak asasi manusia. Oleh karena itu, diperlukan tegasnya pemerintah mengenai imigran tanpa adanya bentuk diskriminasi sesuai dengan instrumen hak asasi manusia internasional dan sesuai dengan konvensi yang berlaku. Penahanan imigran yang dilakukan oleh pemerintah Amerika Serikat sudah seharusnya dihentikan terkhusus imigran dengan negara tertentu. Negara sudah seharusnya melindungi warga negara dan non warga negara sesuai dengan hukum yang berlaku dan menerapkan ICERD.
