Abstract
The costs of organizing the Hajj pilgrimage (BPIH) from year to year is considered not to provide protection for hajj pilgrims as consumers, especially in terms of the value of benefits. The problem of the financing scheme between the composition of Bipih and the value of benefits is not proportional. The problem is identified as follows 1) What are the rights of Hajj pilgrims in the Banten Province Regional Office of the Ministry of Religious Affairs over the 2023 BPIH increase? 2) How is the settlement of the rights of pilgrims who are not fulfilled by the organizers of the Ministry of Religious Affairs, especially in the Regional Office of the Ministry of Religious Affairs of Banten Province on the increase in BPIH in 2023? The type of research used is juridical-empirical. Data on this research is obtained from the Office of the Ministry of Religious Affairs within the Regional Office of the Ministry of Religious Affairs of Banten Province. The approach method in this research is to use a statutory approach and a case approach. Primary data in this study was obtained through interviews from internal Ministry of Religion and external pilgrims. This research was analyzed qualitatively descriptive. The results showed 1) The rights of hajj pilgrims in the Banten Province Ministry of Religious Affairs Regional Office on the 2023 BPIH increase that have been fulfilled include Hajj document services, regular Hajj manasiks, Hajj manasik books, services at the embarkation Hajj dormitory, airplane tickets, luggage (cabin, luggage and waist bags), living costs, identity bracelets, and others; the right to support services, general services in the form of transportation accommodation and catering, health services, and administrative services. While the rights of pilgrims that have not been fulfilled are getting clear information about the value of benefits from BPIH in accordance with the GCPL and Law No.8/2019 Article 7; 2) The settlement of the rights of pilgrims as consumers that are not fulfilled by the Ministry of Religious Affairs' Hajj organizers over the 2023 BPIH increase is that pilgrims can report to the complaint report directly to the Minister of Religion and Ombusman. If there is a civil dispute, it can be resolved through mediation, negotiation and other out-of�court dispute resolution methods in accordance with Article 47 of the GCPL.

| Additional Information: | Biaya Penyelenggaraan Ibadah Haji (BPIH) dari tahun ke tahun dinilai belum memberikan perlindungan jemaah haji sebagai konsumen, terutama dalam hal nilai manfaat. Permasalahan skema pembiayaan antara komposisi Bipih dan nilai manfaat tersebut tidak proporsional. Atas masalah tersebut diidentifikasi 1) Bagaimana hak-hak jemaah haji di lingkungan Kantor Wilayah Kementerian Agama Provinsi Banten atas kenaikan BPIH tahun 2023? 2) Bagaimana penyelesaian terhadap hak-hak jemaah haji yang tidak dipenuhi oleh penyelenggara ibadah haji Kementerian Agama, khususnya di lingkungan Kantor Wilayah Kementerian Agama Provinsi Banten atas kenaikan BPIH tahun 2023? Jenis penelitian yang digunakan adalah yuridis-empiris. Data tentang penelitian ini diperoleh dari Kantor Kementerian Agama di lingkungan Kantor Wilayah Kementerian Agama Provinsi Banten. Metode pendekatan dalam penelitian ini adalah menggunakan pendekatan perundang-undangan dan pendekatan kasus. Data primer dalam penelitian ini diperleh melalui wawancara dari piak internal Kementerian Agama dan eksternal jemaah haji. Penelitian ini dianalisis secara kualitatif deskriptif. Hasil penelitian menunjukkan 1) Hak-hak jemaah haji di lingkungan Kantor Wilayah Kementerian Agama Provinsi Banten atas kenaikan BPIH tahun 2023 yang sudah terpenuhi meliputi seperti pelayanan dokumen haji, manasik haji reguler, buku manasik haji, pelayanan di asrama haji embarkasi, tiket pesawat, koper (kabin, bagasi dan tas pinggang), living cost, gelang identitas, dan lain-lain; hak atas pelayanan pendukung, pelayanan umum berupa transportasi akomodasi dan catering, pelayanan kesehatan, dan pelayanan administrasi. Sementara hak jemaah haji yang belum terpenuhi adalah mendapatkan informasi yang jelas mengenai nilai manfaat dari BPIH sesuai dengan UUPK dan UU No.8/2019 Pasal 7; 2) Penyelesaian terhadap hak-hak jemaah haji sebagai konsumen yang tidak dipenuhi oleh penyelenggara ibadah haji Kementerian Agama atas kenaikan BPIH tahun 2023 adalah jamaah dapat melapor kepada laporan pengaduan langsung ke Menteri Agama dan Ombusman. Apabila terjadi sengketa secara perdata maka dapat diselesaikan melalui mediasi, negosiasi dan cara penyelesaian sengketa di luar pengadilan lainnya sesuai dengan Pasal 47 UUPK. | |||||||||
