Abstract

Land in the legal sense has a very important role in human life because it can determine the existence and continuity of legal relations and actions, both in terms of the individual and the impact on other people. Land that is not registered can cause disputes in the future. One of them is the Serang State Administrative Court Decision Number 13/G/2018/PTUN-SRG which is a dispute arising from the issuance of a certificate of ownership by the Tangerang Regency Land Office as the State Administrative Officer. The identification of the first problem is how to resolve disputes over land rights in Salembaran Jaya Village based on the decision of the State Administrative Court Number 13/G/2018/PTUN-SRG?, then the second is What is the basis for the decision of the Panel of Judges in the decision of the State Administrative Court Number 13/G/2018/PTUN-SRG?. The theory used is the State Administrative Dispute Settlement Theory and the Land Rights Theory. The research method is normative juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. The data collection technique used is literature which is carried out by originating from laws and regulations, books, official documents, publications or with other research results regarding disputes over land ownership certificates. Data obtained and analyzed descriptively with a qualitative approach method. The results of research regarding disputes over certificates of ownership, the Defendant's decision to issue the object of the dispute is contrary to Article 52 paragraphs (1) and (2) of Law Number 30 of 2014 concerning Government Administration. The Defendant decision has contradicted the General Principles of Good Governance (AUPB), especially the principles of accuracy and legal certainty. In conclusion, the Defendant in issuing the land title certificate was not in accordance with the applicable laws and regulations, namely in terms of procedure and substance. The Panel of Judges sentenced the Defendant to revoke and declare null and void the Property Rights Certificate Number 2503/Salembaran Jaya on behalf of Intervening Defendant II. Suggestions to the Tangerang District Land Office in making decisions should be more careful so as to reduce the possibility of disputes over a plot of land. Additional Information: Tanah dalam arti hukum memiliki peranan yang sangat penting dalam kehidupan manusia karena dapat menentukan keberadaan dan kelangsungan hubungan dan perbuatan hukum, baik dari segi individu maupun dampak bagi orang lain. Tanah yang tidak didaftarkan dapat menimbulkan sengketa dikemudian hari. Salah satunya pada Putusan Pengadilan Tata Usaha Negara Serang Nomor 13/G/2018/PTUN-SRG yang merupakan sengketa yang timbul akibat terbitnya sertifikat hak milik oleh Kantor Pertanahan Kabupaten Tangerang selaku Pejabat Tata Usaha Negara. Adapun identifikasi masalah yang pertama yaitu Bagaimana penyelesaian sengketa kepemilikan hak atas tanah di Desa Salembaran Jaya berdasarkan putusan Pengadilan Tata Usaha Negara Nomor 13/G/2018/PTUN-SRG?, kemudian yang kedua ialah Bagaimana dasar keputusan Majelis Hakim dalam putusan Pengadilan Tata Usaha Negara Nomor 13/G/2018/PTUN-SRG?. Teori yang digunakan ialah Teori Penyelesaian Sengketa Tata Usaha Negara dan Teori Hak Atas Tanah. Metode Penelitian yaitu Yuridis Normatif. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data yang digunakan adalah kepustakaan yang dilakukan dengan bersumber dari peraturan perundang-undangan, buku-buku, dokumen resmi, publikasi atau dengan hasil penelitian lainnya mengenai sengketa sertifikat hak milik tanah. Data diperoleh dan analisis secara deskriptif dengan metode pendekatan kualitatif.Hasil penelitian mengenai sengketa sertifikat hak milik, keputusan Tergugat dalam menerbitkan objek sengketa telah bertentangan dengan Pasal 52 ayat (1) dan (2) Undang-Undang Nomor 30 Tahun 2014 tentang Administasi Pemerintahan. Keputusan Tergugat telah beretentangan dengan Asas-asas Umum Pemerintahan yang Baik (AUPB) terutama asas kecermatan dan kepastian hukum. Kesimpulannya Tergugat dalam menerbitkan sertifikat hak milik tanah tidak sesuai dengan peraturan perundang-undangan yang berlaku yaitu secara prosedur dan substansinya. Majelis Hakim menghukum Tergugat untuk mencabut dan menyatakan batal Sertifikat Hak Milik Nomor 2503/Salembaran Jaya atas nama Tergugat II Intervensi. Saran kepada Kantor Pertanahan Kabupaten Tangerang dalam membuat keputusan hendaknya lebih cermat sehingga mengurangi kemungkinan terjadinya sengketa terhadap suatu bidang tanah.
