Abstract

The ban on Indonesian CPO exports to the European Union is due to a policy entitled the Delegated Regulation Supplementing Directive of The EU Renewable Energy Directive II and RED. This was established against the background of the condition of the European Union which is dependent on fossil fuel energy sources, the policy issued is considered to discriminate against this product. palm oil because it limits market access to palm oil and palm oil-based biofuels resulting in a negative impact on Indonesian palm oil exports to the European Union market. Based on this background, the problem being studied is the reason. The European Union bans Crude Palm Oil (CPO) from Indonesia? and does the European Union's Renewable Energy Directive II (RED II) policy on Indonesian Crude Palm Oil (CPO) conflict with Technical Barriers Trade (TBT)? Using protectionist theory and the principle of non-discrimination. This research uses normative juridical research methods. Through this research method, it was found that the policies issued by the European Union against Indonesia for boycotting CPO have been refuted by the Indonesian government through certification in the form of RSPO, ISCC, SAN and ISPO. Such certification must be carried out under the principle of non-discrimination (MFN). In practice in the field, the application of MFN principles in international trade often does not work easily. This can be seen from the European Union's boycott of CPO against Indonesia, in which RED II was deemed to have violated the MFN principle, including discriminating against Indonesian CPO from other vegetable oils. Dispute resolution at the WTO can be resolved through the DSB institution. Regarding the CPO boycott dispute by the European Union, Indonesia can make several efforts, namely by taking actions that are power-based, actions that are right-based, and actions that are interest-based.

Additional Information: Pelarangan ekspor CPO Indonesia ke Uni Eropa karena sebuah kebijakan yang di bertajuk Delegated Regulation Supplementing Directive of The EU Renewable Energy Directive II dan RED ini ditetapkan dari latar belakang kondisi Uni Eropa yang bergantung pada sumber energi bahan bakar fosil, kebijakan yang dikeluarkan tersebut diangggap mendiskriminasi produk kelapa sawit karena membatasi akses pasar minyak kelapa sawit dan Biofuel berbasis minyak kelapa sawit sehingga berdampak negatif terhadap ekspor kelapa sawit Indonesia di pasar Uni Eropa. Berdasarkan latar belakang tersebut, masalah yang dikaji adalah alasan. Uni Eropa melarang Crude Palm Oil (CPO) dari Indonesia? dan apakah kebijakan Renewable Energy Directive II (RED II) dari Uni Eropa terhadap Crude Palm Oil (CPO) Indonesia bertentangan dengan Technical Barriers Trade (TBT)? Menggunakan teori proteksionis dan prinsip non-diskriminasi. Penelitian ini menggunakan metode penelitian yuridis normatif. Melalui metode penelitian tersebut diperoleh hasil bahwa kebijakan-kebijakan yang dikeluarkan Uni Eropa terhadap Indonesia atas pemboikotan CPO telah dibantah pemerintah Indonesia melalui sertifikasi berupa RSPO, ISCC, SAN dan ISPO. Sertifikasi tersebut harus dilaksanakan dengan prinsip non-diskriminasi (MFN). Dalam praktiknya di lapangan, penerapan prinsip MFN dalam perdagangan internasional sering kali tidak dapat berjalan dengan mudah. Hal tersebut dapat dilihat dari kasus pemboikotan CPO oleh Uni Eropa terhadap Indonesia, yang mana RED II dianggap melanggar prinsip MFN termasuk mendiskriminasi CPO Indonesia dari minyak nabati lainnya. Penyelesaian sengketa di WTO dapat diselesaikan melalui lembaga DSB. Terkait sengketa pemboikotan CPO yang dilakukan Uni Eropa, Indonesia dapat melakukan beberapa upaya yaitu dengan tindakan yang sifatnya power based, tindakan yang sifatnya right based, serta tindakan yang sifatnya interest based.
