Abstract
During the Covid-19 pandemic, the dynamics of the Election Organizers were affected in carrying out their responsibilities for conducting and overseeing the Elections. The background of this writing stemmed from the numerous issues related to the establishment of legal regulations during the Election stages. In accordance with the provisions of the General Election Commission Regulation Number 13 of 2020 concerning the Second Amendment to General Election Commission Regulation Number 6 of 2020 on the Implementation of the Election of Governors and Deputy Governors, Regents and Deputy Regents, and/or Mayors and Deputy Mayors, which served as the foundation for implementing the 2020 Elections during the Covid-19 pandemic. The Election Supervisory Agency (Bawaslu) was granted additional authority in the form of written warnings, which were enacted in the General Election Commission Regulation. This research was conducted to understand and assess the authority of the Election Supervisory Agency (Badan Pengawas Pemilihan Umum) in carrying out its powers regarding the handling of election violations, as viewed through Law Number 6 of 2020 concerning the Enactment of Government Regulation in Lieu of Law Number 2 of 2020 concerning the Third Amendment to Law Number 1 of 2015 concerning the Enactment of Government Regulation in Lieu of Law Number 1 of 2014 concerning the Election of Governors, Regents, and Mayors into Law. The research also aimed to investigate and analyze the follow-up measures taken in handling alleged violations during the Covid-19 pandemic. In conducting this study, institutional theory and authority theory were used as analytical tools to examine the position of Bawaslu's authority in addressing election violations during the Covid-19 pandemic. The method used in this research was empirical legal analysis with a synchronic approach, based on primary data in the form of interviews and secondary data consisting of legislation, books, journals, and scholarly works related to the topic under study. The objective was to ascertain whether a specific legal regulation indeed had a valid basis in its formation and served a practical purpose. Both the data collected from interviews conducted during fieldwork and the literature review were examined descriptively. The findings of this research revealed the existence of discrepancies in the formulation of legal regulations, leading to legal uncertainties for the election organizers and the public during the 2020 Regional Elections held amidst the Covid-19 outbreak in the Province of Banten. The results of this study could provide valuable input for the formulation of legal regulations to align with the provisions governing their formation and to ensure legal certainty for government institutions and society. Furthermore, it was recommended that Election Supervisory Agency adhered to the relevant laws and regulations governing the handling of election violations as implementation regulations of the main law.

| Additional Information: | Pandemi Covid-19 telah menciptakan dinamika bagi Penyelenggara Pemilu dalam menjalankan tanggung jawab penyelenggaraan dan pengawasan Pemilu, Latar belakang penulisan ini berasal dari banyaknya persoalan pembentukan peraturan perundang-undangan pada tahapan Pemilu. Sesuai dengan ketentuan Peraturan KPU Nomor 13 Tahun 2020 tentang Perubahan Kedua atas Peraturan KPU Nomor 6 Tahun 2020 tentang Penyelenggaraan Pemilihan Gubernur dan Wakil Gubernur, Bupati dan Wakil Bupati, dan/atau Walikota dan Wakil Walikota merupakan peraturan yang menjadi dasar pelaksanaan Pemilihan Tahun 2020 di masa pandemic covid-19. Bawaslu sebagai lembaga pengawas pelaksanaan penyelenggaraan Pemilihan yang dilaksanakan oleh KPU memiliki kewenangan tambahan berupa peringatan tertulis yang dituangkan ke dalam Peraturan KPU. Penelitian ini dilakukan untuk memahami dan menilai kedudukan kewenangan Badan Pengawas Pemilihan Umum dalam melaksanakan kewenangan terhadap penanganan pelanggaran Pemilihan ditinjau dari Undang-Undang Nomor 6 Tahun 2020 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2020 Tentang Perubahan Ketiga atas Undang-Undang Nomor 1 Tahun 2015 Tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 tentang Pemilihan Gubernur, Bupati, dan Walikota menjadi Undang-Undang serta untuk mengetahui dan menganalisis tindaklanjut penanganan dugaan pelanggaran pada masa pandemic covid-19. Penelitian ini menggunakan teori kelembagaan dan teori kewenangan sebagai pisau analisis kedudukan kewenangan Bawaslu dalam menangani pelanggaran Pemilihan dalam masa pandemic covid-19. Metode yang digunakan dalam penelitian ini merupakan analisis hukum empiris dengan pendekatan sinkronisasi hukum yang berasal dari data primer berupa wawancara dan data sekunder berupa peraturan perundang-undangan, buku, jurmal, dan karya ilmiah yang berkaitan dengan topik yang dipelajari. Ini bertujuan untuk memastikan apakah suatu peraturan perundang-undnangan tertentu benar-benar memiliki dasar dalam pembentukannya dan memiliki daya guna. Data yang dikumpulkan dari wawancara yang dilakukan selama kerja lapangan serta studi pustaka keduanya diperiksa secara deskriptif. Temuan dari permasalahan ini menunjukkan adanya ketidaksepahaman dalam penyusunan peraturan perundang-undangan yang berujung pada ketidakpastian hukum bagi penyelenggara pemilu dan masyarakat ketika Tahapan Pemilihan dilaksanakan pada tahun 2020 di tengah wabah Covid-19 di Provinsi Banten. Hasil penelitian ini dapat memberikan masukan terhadap setiap pembentukan peraturan perundang-undangan agar sesuai dengan ketentuan yang telah diatur mengenai pembentukan peraturan perundang-undangan dan dapat memberikan kepastian hukum pada setiap lembaga negara dan masyarakat serta merekomendasikan kepada Bawaslu untuk tetap berpedoman kepada Undang-Undang dan Peraturan Bawaslu yang mengatur mengenai mekanisme penanganan pelanggaran Pemilihan sebagai peraturan pelaksanaan Undang-Undang. | |||||||||
