Abstract

The European Union has regulations that are a reference for data protection throughout the world, namely the General Data Protection Regulation (GDPR). Maximillian Schrems, a citizen of the European Union sued Facebook in Ireland, because Facebook's alleged involvement with the reconnaissance program (PRISM) of the United States National Security Agency (NSA). The legal differences between the two continents are a problem for the protection of personal data in the European Union. Based on this background, the problem studied in this study is what is the role of the state in protecting personal data so that data breaches do not occur in terms of the General Data Protection Regulation? and how is the implementation of the 2018 General Data Protection Regulation against personal data violations in the case of Maximilian Schrems vs Facebook. The framework of thought in this research is the theory of legal protection and the theory of extraterritorial jurisdiction. The research method in this thesis is normative juridical. The data source used in this study is a secondary data source. The results of the study show that with the existence of the GDPR, the European Union has provided protection for the personal data of its citizens. Every corporation or organization that wishes to process user data of citizens residing in the European Union must have guarantees for the protection of personal data. The country where the corporation is located must have regulations equivalent to the GDPR or to international treaties approved by the European Commission. Researchers believe that in implementing GDPR based on the Maximilian Schrems vs Facebook case, strengthening international cooperation, increasing privacy education and consistent law enforcement in member countries should be required. Routine audits and evaluation of data transfer policies and collaboration with the technology industry need to be improved. Data security and encryption should be a primary focus, while maintaining the integrity of data agreements with third parties.

Additional Information: Uni Eropa mimiliki regulasi yang menjadi acuan perlindungan data di seluruh dunia, yaitu General Data Protection Regulation (GDPR). Maximillian Schrems, seorang warga negara Uni Eropa menggugat Facebook di Irlandia, karena dugaan keterlibatan Facebook dengan program pengintaian (PRISM) dari National Security Agency (NSA) Amerika Serikat. Perbedaan hukum antara kedua benua ini menjadi permasalahan bagi perlindungan data pribadi di Uni Eropa. Berdasarkan latar belakang tersebut, permasalahan yang dikaji dalam penelitian ini adalah bagaimana peran negara dalam perlindungan agar tidak terjadi pelanggaran data pribadi ditinjau dari General Data Protection Regulation? dan bagaimana implementasi General Data Protection Regulation 2018 terhadap pelanggaran data pribadi dalam kasus Maximilian Schrems vs Facebook?. Kerangka pemikiran dalam penelitian ini adalah teori perlindungan hukum dan teori yurisdiksi ekstrateritorial. Metode penelitian dalam skripsi ini berupa yuridis normatif. Sumber data yang digunakan dalam penelitian ini adalah sumber data sekunder. Hasil penelitian menunjukan bahwa dengan adanya GDPR, Uni Eropa telah memberikan perlindungan data pribadi warga negaranya. Setiap korporasi atau organisasi yang ingin memproses data pengguna warga negara yang bertempat tinggal di Uni Eropa wajib memiliki jaminan atas perlindunagan data pribadi. Negara di mana tempat korporasi itu berada harus memiliki regulasi yang setara dengan GDPR atau dengan perjanjian internasional yang disetujui oleh Komisi Eropa. Peneliti berpendapat bahwa seharusnya dalam implementasi GDPR berdasarkan kasus Maximilian Schrems vs Facebook, diperlukan penguatan kerja sama internasional, peningkatan edukasi privasi, dan penegakan hukum yang konsisten di negara anggota. Audit rutin dan evaluasi kebijakan transfer data serta kolaborasi dengan industri teknologi perlu ditingkatkan. Keamanan data dan enkripsi harus menjadi fokus utama, sambil menjaga integritas perjanjian data dengan pihak ketiga.
