Abstract

The 1944 Chicago Convention on International Aviation Regulations is the legal umbrella in imposing sanctions on violations of foreign civil aircraft type DA62 registration G-DVOR for Malaysia. There are two problems that arise, namely, the first problem is how are the regulations for applying sanctions according to the 1944 Chicago Convention and secondly, how effective was the 1944 Chicago Disruption in the case of a foreign civil aircraft type DA62 registered G-DVOR for Malaysia? The theory of state sovereignty and law enforcement theory are the basic theories that the author will use in explaining the application of sanctions by the Indonesian national law to this violation case. The method used is empirical juridical assisted by normative juridical as a supporting reference. The results of this study are: First, that the 1944 Chicago Convention is considered ineffective in becoming a legal umbrella for civil aircraft aviation regulations because it has not followed the development of civil aviation. The ineffectiveness of the contents of the convention is the reason that the 1944 Chicago Convention is also ineffective in becoming a reference for imposing sanctions on violations of type DA62 foreign civil aircraft registered G-DVOR for Malaysia. Second, there is no clear communication and coordination regarding sanctions for administrative fines between Civil Servants Examination Officials (PPNS) who provide inspections of aircraft, the Indonesian Air Force who are charged with supporting aircraft, and the Ministry of Transportation who are charged with giving nominal administrative fines. regarding the nominal administrative fines that should be given is also not written down and is a problem because according to the Indonesian Air Force, administrative fines should be considered as a punishment, seeing as the funds spent during the reduction are very large and far from the fines given for civil aircraft violations.

Additional Information: Konvensi Chicago 1944 tentang Peraturan Penerbangan Internasional merupakan payung hukum dalam pemberian sanksi kepada pelanggaran pesawat sipil asing tipe DA62 registrasi G-DVOR tujuan Malaysia. Terdapat dua masalah yang muncul yaitu, masalah pertama adalah bagaimana peraturan penerapan sanksinya menurut Konvensi Chicago 1944? dan yang kedua bagaimana efektivitas Konvensi Chicago 1944 terhadap kasus pesawat sipil asing tipe DA62 registrasi G-DVOR tujuan Malaysia? Teori kedaulatan negara dan teori penegakan hukum menjadi teori dasar yang akan penulis gunakan dalam menjelaskan penerapan sanksi oleh hukum nasional negara Indonesia terhadap kasus pelanggaran ini. Metode yang digunakan adalah yuridis empiris dibantu dengan yuridis normatif sebagai referensi pendukung. Hasil dari penelitian ini adalah: Pertama, bahwa Konvensi Chicago 1944 ternilai tidak efektif dalam menjadi payung hukum untuk peraturan penerbangan pesawat sipil karena sudah tidak mengikuti perkembangan penerbangan sipil. Tidak efektifnya isi konvensi tersebut menjadi alasan bahwa Konvensi Chicago 1944 juga tidak efektif dalam menjadi acuan pemberian sanksi kepada pelanggaran pesawat sipil asing tipe DA62 registrasi G-DVOR tujuan Malaysia. Kedua, tidak ada komunikasi dan koordinasi yang jelas tentang nominal sanksi denda administratif antara Pejabat Pemeriksa Pegawai Negeri Sipil (PPNS) yang berwenang dalam pemeriksaan pesawat, TNI Angkatan Udara yang berwenang dalm menurunkan pesawat, dan Kementrian Perhubungan yang berwenang dalam memberikan nominal denda administratif. peraturan tentang nominal denda administratif yang seharusnya diberikan juga tidak tertulis dan menjadi masalah karena menurut TNI AU, denda administratif harus dipertimbangkan jumlahnya, melihat dana yang dikeluarkan saat penurunan sangat besar dan jauh dari denda yang diberikan kepada pelanggaran pesawat sipil.
