Abstract

Consequence testing is a test of the consequences that arise if information is provided to the public by carefully considering that closing public information can protect greater interests than opening it or vice versa. Consequence testing is the initial stage before public information is classified and designated as exempt public information. The problem: First, What are the responsibilities of local authorities in the Banten Provincial Government in conducting consequential testing of exempt public information? Secondly, What are the legal implications of testing the consequences of exempt public information for regional apparatus and the public? The method used is normative juridical and empirical juridical, data analysis is carried out in a qualitative descriptive manner. The results of this research are: Firstly, out of 39 (thirty-nine) regional apparatus in the Banten Provincial Government, only 15 (fifteen) regional apparatus have conducted consequential testing on exempt public information: Secondly, the legal implications of not conducting consequential harm testing on exempt public information are that every piece of public information produced by a local government is open and freely accessible to the public. Meanwhile, if the regional apparatus conducts consequence testing, then the regional apparatus has the right to determine exempt public information and has the right to reject requests for exempt public information, and for the public has the right to file objections and lawsuits if requests for public information are hampered or rejected.

Additional Information:	Pengujian konsekuensi adalah pengujian tentang konsekuensi yang timbul apabila suatu informasi diberikan kepada masyarakat dengan mempertimbangkan secara seksama bahwa menutup informasi publik dapat melindungi kepentingan yang lebih besar daripada membukanya atau sebaliknya. Pengujian konsekuensi merupakan tahapan awal sebelum informasi publik diklasifikasi dan ditetapkan sebagai informasi publik yang dikecualikan. Masalahnya: Pertama, Bagaimana tanggung jawab perangkat daerah di Pemerintah Provinsi Banten dalam melakukan pengujian tentang Konsekuensi terhadap informasi publik yang dikecualikan? Kedua, Bagaimana implikasi hukum pengujian tentang konsekuensi terhadap informasi publik yang dikecualikan bagi Perangkat Daerah dan masyarakat? Metode yang digunakan yuridis normatif dan yuridis empiris, analisis data dilakukan secara deskriktif kualitatif. Adapun hasil penelitian ini adalah: Pertama dari 39 (tiga puluh sembilan) perangkat daerah di Pemerintah Provinsi Banten, baru 15 (lima belas) perangkat daerah yang sudah melakukan pengujian tentang konsekuensi terhadap informasi publik yang dikecualikan: Kedua, implikasi hukum yang timbul jika perangkat daerah tidak melakukan pengujian tentang konsekuensi maka dengan sendirinya setiap informasi publik yang dihasilkan oleh perangkat daerah, seluruhnya menjadi informasi terbuka dan bebas diakses oleh masyarakat. Sedangkan jika perangkat daerah melakukan pengujian tentang konsekuensi, maka perangkat daerah memiliki hak untuk menetapkan informasi publik yang dikecualikan dan berhak menolak permintaan informasi publik yang dikecualikan, dan bagi masyarakat berhak untuk mengajukan keberatan dan gugatan apabila permintaan informasi publik mengalami hambatan atau penolakan.
