Abstract

Cyber Notary is a renewal concept for the service of making notarial deeds which is carried out by utilizing technological advances or can be done electronically which is planned by the government. However, in the process there is still a legal urgency for the legalization of making a deed using a cyber notary so that it becomes an authentic deed that is legally valid. The existence of conflicting articles can cause legal problems in the future. So the authors conducted research, namely, How is the legal certainty of notary deed based on cyber notary linked to the principle of tabellionis officium fideliter exercebo based on law number 2 of 2014 concerning the position of notary and civil law code books and How is legal protection for users of notary deed based on cyber notary connected with the principle of tabellionis officium fideliter exercebo based on law number 2 of 2014 concerning the position of notary and civil law code books. The research was carried out using the theory of legal certainty and the theory of legal protection using normative juridical research methods with the type of analytical descriptive research using the statutory approach. The data sources used in this research are primary legal materials, secondary materials and tertiary materials. The data collection technique used in this study was through a literature study and then analyzed qualitatively normatively. The results of the study concluded that the legal certainty of a notarial deed made by cyber notary does not yet have absolute legal force. And legal protection for users of cyber notary-based deeds is still weak in regulation because there are no definite rules that can guarantee this in UUJN. Suggestions for the government to immediately renew civil law, especially in the field of notaries, so that they can provide legal certainty and protection in their duties and authorities for making deeds using cyber notaries and users of these deeds.

Additional Information: Cyber Notary merupakan konsep pembaharuan terhadap pelayanan pembuatan akta notaris yang dilakukan dengan memanfaatkan kemajuan teknologi atau dapat dilakukan secara elektronik yang direncanakan oleh pemerintah. Namun dalam prosesnya masih terdapat urgensi hukum terhadap legalisasi pembuatan akta secara cyber notary agar menjadi akta otentik yang sah menurut hukum. Adanya pasal yang berbenturan dapat menyebabkan permasalahan hukum dikemudian hari. Maka penulis melakukan penelitian yaitu, Bagaimana kepastian hukum akta notaris berbasis cyber notary dihubungkan dengan asas tabellionis officium fideliter exercebo berdasarkan undang-undang nomor 2 tahun 2014 tentang jabatan notaris dan kitab undang-undang hukum perdata dan Bagaimana perlindungan hukum terhadap pengguna akta notaris berbasis cyber notary dihubungkan dengan asas tabellionis officium fideliter exercebo berdasarkan undang-undang nomor 2 tahun 2014 tentang jabatan notaris dan kitab undang-undang hukum perdata. Penelitian dilakukan dengan menggunakan teori kepastian hukum dan teori perlindungan hukum dengan menggunakan metode penelitian yuridis normatif dengan jenis penelitian deskripstif analisis yang menggunakan metode pendekatan Perundang-undangan. Sumber data yang digunakan dalam penelitian ini bahan hukum primer, bahan sekunder dan bahan tersier. Teknik pengumpulan data yang digunakan dalam penelitian ini melalui studi kepustakaan kemudian dianalisis secara kualitatif normatif. Hasil penelitian menyimpulkan bahwa kepastian hukum akta notaris yang dibuat secara cyber notary belum memiliki kekuatan hukum yang mutlak. Dan Perlindungan hukum bagi pengguna akta berbasis cyber notary masih lemah regulasinya dikarenakan belum adanya aturan yang pasti yang dapat menjamin hal tersebut di dalam UUJN. Saran terhadap pemerintah untuk segera melakukan pembaharuan hukum keperdataan terutama dalam bidang notaris, agar dapat memberikan kepastian dan perlindungan hukum dalam tugas & kewenangannya untuk pembuatan akta secara cyber notary dan pengguna akta tersebut.
