Abstract
Consignment for compensation for land acquisition for the construction of Jalan Raya Bekasi, East Jakarta Administrative City proposed by the Regional Government of DKI Jakarta c.q. Agency of Highways DKI Jakarta because there are several parties who claim land ownership with different rights. This is done so that there are no errors in paying compensation for land acquisition and to avoid problems arising in the future. From this, it is necessary to examine how the implementation of the consignment mechanism in land acquisition for development in the public interest after the issuance of Law Number 11 of 2020 concerning Job Creation and the obstacles faced and efforts to overcome these obstacles. The research method used in the preparation of this thesis is normative-empirical. Data sources through primary data and secondary data are then processed and presented by comparing field data with expert opinions or with laws and regulations which are used as a juridical basis in research. Based on the results of the research, it was found that the implementation of the consignment for the construction of Jalan Raya Bekasi, East Administrative City was carried out by following the provisions in accordance with the Amendments to Law No. 2 of 2012 concerning Land Acquisition for Public Interest is regulated in the Job Creation Law, Government Regulation No. 19 of 2021 concerning the Implementation of Land Acquisition for Public Interest, along with the technical regulations contained in the Supreme Court Rules concerning Procedures for Submitting Objections and Custody of Compensation to the District Court in Land Procurement for Development for Public Interest. However, in practice, the implementation of the consignment mechanism at the East Jakarta District Court exceeds the specified time limit. Some of the obstacles include: 1) the consignment mechanism has not been well socialized within the District Court; 2) lack of coordination in the process of requesting money/delegation assistance because some of the consignee respondents live outside the jurisdiction of the East Jakarta District Court; and 3) facilities and infrastructure factors.

Dinas Bina Marga DKI Jakarta dikarenakan adanya beberapa pihak yang mengklaim kepemilikan tanah dengan alas hak yang berbeda-beda. Hal ini dilakukan agar tidak terjadi kesalahan dalam pembayaran ganti kerugian pengadaan tanah serta untuk menghindari timbulnya permasalahan dikemudian hari. Dari hal tersebut maka perlu diteliti bagaimana penerapan mekanisme konsinyasi dalam pengadaan tanah bagi pembangunan untuk kepentingan umum pasca terbitnya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan kendala yang dihadapi serta upaya dalam mengatasi kendala tersebut. Metode penelitian yang digunakan dalam penyusunan tesis ini adalah normatif-empiris. Sumber data melalui data primer dan data sekunder kemudian diolah dan disaji dengan cara membandingkan antara data lapangan dengan pendapat para ahli atau dengan peraturan perundang-undangan yang dijadikan dasar yuridis dalam penelitian. Berdasarkan hasil penelitian yang didapat bahwa pelaksanaan konsinyasi untuk pembangunan Jalan Raya Bekasi Kota Administrasi Timur dilakukan dengan mengikuti ketentuan sesuai dengan Perubahan atas Undang-Undang No. 2 Tahun 2012 tentang Pengadaan Tanah Untuk Kepentingan Umum diatur dalam UU Cipta Kerja, Peraturan Pemerintah No. 19 Tahun 2021 tentang Penyelenggaraan Pengadaan Tanah Untuk Kepentingan Umum, beserta peraturan teknisnya yang termuat dalam Perma tentang Tata Cara Pengajuan Keberatan dan Penitipan Ganti Kerugian Ke Pengadilan Negeri Dalam Pengadaan Tanah Bagi Pembangunan Untuk Kepentingan Umum. Namun pada prakteknya, penerapan mekanisme konsinyasi di Pengadilan Negeri Jakarta Timur melebihi tenggang waktu yang ditentukan. Beberapa kendalanya antara lain: 1) mekanisme konsinyasi belum tersosialisasi dengan baik di lingkungan Pengadilan Negeri; 2) kurangnya koordinasi untuk proses permohonan bantuan penawaran uang/ delegasi dikarenakan beberapa termohon konsinyasi bertempat tinggal di luar wilayah hukum Pengadilan Negeri Jakarta Timur; dan 3) faktor fasilitas dan sarana. | |||||||||
