Abstract

Forensic psychiatry is a branch of psychiatry that has a forensic function. Forensic psychiatric examination by a psychiatrist is carried out from the police investigation level to a court trial, to determine whether or not there is a mental disorder in the perpetrator of a crime. From here it is determined whether capable or not the perpetrator is responsible for his actions. The Psychiatrist's testimony is contained in the Visum et Repertum Psychiatricum (VeRP) and becomes the judge's consideration for perpetrators who have mental disorders in the judicial process. The focus of this research is on the case study of court decision number 12/Pid.Sus-Anak/2020/PN Jkt.Pst. A 14-year-old child was sentenced to 6 years in prison at the Class I Child Correctional Institution (LPKA) Tangerang, After killing her sister's playmate by drowning him in a bathtub, the perpetrator is suspected of having a mental disorder. Based on this background, the researcher wishes to examine the role of forensic psychiatry in handling the crime of murder and how the criminal responsibility for the perpetrators of the crime of murder, using the theory of forensic psychiatry and criminal responsibility. This research was conducted using a normative juridical method. The research approach uses a literature study approach. Sources of data used in this study are secondary data sources. The findings in this study are that the perpetrators are declared capable of being responsible but the judge decides to punish the perpetrators by submitting them to the Social Welfare Organization (LPKS). This study concludes that forensic psychiatry acts as an auxiliary science to provide information to law enforcement about the mental condition of a perpetrator of a murder crime, then as a consideration in determining the ability of the perpetrators of the crime of murder to be responsible for their criminal acts. For this reason, the judge must look at the relations between the elements of criminal responsibility that have been fulfilled by referring to the VeRP and punish the perpetrator by submitting it to LPKA.

Dari sinilah ditentukan mampu atau tidaknya pelaku bertanggungjawab atas perbuatannya. Kesaksian Psikiater dituangkan dalam Visum et Repertum Psychiatricum (VeRP) dan menjadi bahan pertimbangan hakim terhadap pelaku yang sakit jiwa dalam proses peradilan. Fokus penelitian ini ialah pada studi putusan nomor 12/Pid.Sus-Anak/2020/PN Jkt.Pst. Seorang anak berusia 14 tahun dituntut pidana penjara selama 6 tahun di Lembaga Pembinaan Khusus Anak (LPKA) Klas 1 Tangerang, setelah membunuh teman bermain adiknya dengan ditenggelamkan kedalam bak, pelaku diduga memiliki kelainan kejiwaan. Berdasarkan latar belakang tersebut, peneliti berkeinginan untuk mengkaji bagaimana peranan ilmu psikiatri forensik dalam penanganan tindak pidana pembunuhan dan bagaimana pertanggungjawaban pidana terhadap pelaku tindak pidana pembunuhan, menggunakan teori ilmu psikiatri forensik dan pertanggungjawaban pidana. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif. Pendekatan penelitian menggunakan pendekatan studi kepustakaan. Sumber data yang digunakan dalam penelitian ini adalah sumber data sekunder. Temuan dalam penelitian ini adalah pelaku dinyatakan mampu bertanggungjawab namun Hakim memutus untuk menghukum pelaku dengan diserahkan ke Lembaga Penyelenggaraan Kesejahteraan Sosial (LPKS). Penelitian ini menghasilkan kesimpulan bahwa ilmu psikiatri forensik berperan sebagai ilmu bantu untuk memberikan keterangan kepada penegak hukum tentang kondisi kejiwaan seorang pelaku tindak pidana pembunuhan, kemudian sebagai pertimbangan dalam menentukan kemampuan pelaku tindak pidana pembunuhan mempertanggungjawabkan perbuatan pidananya. Untuk itu seharusnya Hakim melihat hubungan antara unsur pertanggungjawaban pidana yang telah terpenuhi dengan mengacu kepada VeRP dan menghukum pelaku dengan diserahkan ke LPKA.
