Abstract

The problem of children facing the law, especially child perpetrators, has regulated the rights and provisions for handling them in Indonesia in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System in the Justice System starting from Investigation, Prosecution, Courts and Corrections. In practice, in the investigation process by the police there are still discrepancies, such as in the beating case that occurred in Serang City where one of the 13 perpetrators was a minor, namely RA, who in the investigation process was handled by the Jatanras unit at the Serang City Police Resort (Polres Serang Kota). These minors or the perpetrator's child are handled by the Police in a unit that is not supposed to be, namely the Crime and Violence Unit (Jatanras), even though according to PERKAPOLRI NO. POL. : 10 YEAR 2007 Concerning the Organization and Work Procedure of the Women and Children Service Unit, it is clear that child perpetrators are also part of the duties of the PPA Unit to deal with and also the unit's role as child investigators. Researchers use the theory of criminal law enforcement and the theory of criminal law protection. This study used a qualitative research method with a case approach and a statutory approach, then used secondary data sources and primary data sources in the form of interviews with members of the Police concerned as supporting data, then data collection techniques using literature study and interviews and analyzed descriptively. research found that law enforcement incompatibility will directly affect the rights of the offender's children who need to be protected. The investigator's suggestion for child perpetrators is a vital thing that law enforcement must ideally look at against child perpetrators as stated in the principle of "best interests for the child" through enforcement of enforcement factors so that protection for child perpetrators of their rights will be fulfilled.

Additional Information:	Persoalan anak berhadapan hukum khususnya anak pelaku telah diatur hak-hak dan ketentuan penanganannya di Indonesia dalam Undang-undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak dalam Sistem Peradilan mulai dari Penyidikan, Penuntutan, Pengadilan dan Pemasyarakatan. Prakteknya pada kasus pengeroyokan yang terjadi di Kota Serang yang mana salah satu pelaku dari 13 pelaku adalah anak dibawah umur, yaitu RA yang dalam proses penyidikannya ditangani oleh unit Jatanras di Kepolisian Resor Serang Kota (Polres Serang Kota). Anak dibawah umur tersebut atau anak pelaku tersebut ditangani oleh Kepolisian pada unit yang bukan seharusnya. Identifikasi masalah ini bagaimana penegakan hukum terhadap proses penyidikan anak pelaku pengeroyokan oleh Kepolisian pada kasus laporan nomor LP.B/263/VIII/2019/SPKT di Kepolisian Resor Serang Kota dan bagaimana perlindungan hukum terhadap hak-hak anak pelaku pengeroyokan pada proses penyidikan di Kepolisian pada kasus laporan nomor LP.B/263/VIII/2019/SPKT di Kepolisian Resor Serang Kota. Teori yang digunakan yaitu teori penegakan hukum pidana dan teori perlindungan hukum pidana. Metode yang digunakan yakni penelitian kualitatif dengan pendekatan kasus dan pendekatan Undang-undang. Sumber data yakni sekunder dan sumber data primer berupa wawancara dengan anggota Kepolisian terkait sebagai data pendukung, teknik pengumpulan data dengan studi pustaka serta wawancara dan dianalisis secara deskriptif analisis. Hasil penelitian yang didapat ketidak sesuaian penegakan hukum bagi anak pelaku tersebut yang mana secara langsung akan berpengaruh terhadap hak-hak anak pelaku yang perlu dilindungi akibat dari penegakan yang digunakan secara umum atau bukan khusus bagi anak. Kesimpulan penanganan belum ideal sesuai dengan yang tercantum dari kedua peraturan tersebut hal ini juga didukung dari 5 faktor yang digunakan untuk meneliti kasus. Saran penyidik anak pelaku sebagai hal vital yang harus dilakukan penegakan hukum secara ideal melihat terhadap pelaku anak seperti yang telah disebutkan dalam asas “kepentingan terbaik bagi anak” melalui penegakan dari faktor penegakan sehingga perlindungan bagi anak pelaku terhadap hak-haknya akan terpenuhi.
