Abstract
From a legal standpoint, motorized vehicle modifications must be in line with applicable rules and regulations to ensure legal certainty and the legitimacy of motorized vehicle owners. According to a community phenomenon, many public workshops in the Serang region that modify vehicles do not include recommendations from a single representative of the brand holder. The researcher determined the problem by referring to these problems. First, how is the Serang Resort Police enforcement of criminal legislation against goods transport company players that modify motorized vehicles in accordance with the Act Number 22 of 2009 about Traffic and Road Transportation in Serang Resort Police? Second, what is the criminal responsibility for goods transport company players that change it in accordance with Serang Resort Police based on Act 22 of 2009 about Road Traffic and Transportation?. The thesis research method uses normative juridical, the approach is based on the statute approach. The findings from the research are as follows: law enforcement can be implemented effectively and with maximum results; the success of law enforcement is dependent on three instruments, namely legal structure, legal substance, and legal culture, all of which have a strong relationship with one another; a result of freight forwarders' unwillingness to follow applicable rules and regulations, they must be held criminally responsible under the notions of strict liability and vicarious liability. The researcher concluedes that law enforcement for traffic and road transport crimes hasn’t been optimally synergized between the Serang Resort Police, Department of Land Transportation Serang District, and The Land Transportastation Management Center VIII; There is a legal void in the Road Transportation Traffic Law, namely: legal certainly regulating Corporations, General worksshops for Business Actors, Application of maximum criminal sanctions, and protection for freight transportation. Culture of bribery, selective logging in prosecution, human resources who do not know the law and abuse of power for personal or group interests and criminal liability with an emphasis on elements of error based on the concept of strict liability and vicarious liability.

| Additional Information: | Modifikasi kendaraan bermotor apabila dilihat dari perspektif ilmu hukum harus sesuai dengan peraturan perundang-undangan yang berlaku untuk menjamin kepastian hukum serta keabsahan pemilik kendaraan bermotor. Berdasarkan pada fenomena yang terjadi di masyarakat, banyaknya bengkel-bengkel umum di Kabupaten Serang yang melakukan modifikasi kendaraan tidak dilengkapi rekomendasi dari Agen Tunggal Pemegang Merek. Mengacu pada permasalahan tersebut, peneliti melakukan identifikasi masalah. Pertama Bagaimana penegakan hukum pidana oleh Kepolisian Resor Serang terhadap pelaku usaha angkutan barang yang memodifikasi kendaraan bermotor berdasarkan Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan Di Wilayah Hukum Polres Serang ? , Kedua Bagaimana pertanggungjawaban pidana terhadap pelaku usaha angkutan barang yang memodifikasi berdasarkan Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan Di Wilayah Hukum Polres Serang ? . Metode penelitian tesis menggunakan yuridis normatif, pendekatan yang dilakukan berdasarkan metode pendekatan undang-undang (statute approach). Hasil dalam penelitian ini yaitu: pelaksanaan penegakan hukum oleh penegak hukum dapat berjalan efektif dengan hasil maksimal, keberhasilan penegakan hukum bergantung pada tiga instrumen, yaitu struktur hukum, substansi hukum dan kultur hukum, dimana antara satu sama lain mempunyai hubungan kuat; Ketidakpatuhan pengusaha angkutan barang terhadap peraturan perundang-undangan yang berlaku, sehingga perlu dipertanggujawabkan secara pidana berdasarkan konsep strict liability dan vicarious liability. Peneliti simpulkan bahwa penegak hukum pidana lalu lintas dan angkutan jalan belum bersinergi secara maksimal antara Kepolisian Resor Serang, Dinas Perhubungan Darat Kabupaten Serang dan Balai Pengelola Transportasi Darat VIII; Terdapat kekosongan hukum dalam Undang-Undang Tentang Lalu Lintas Angkutan Jalan, yaitu : kepastian hukum yang mengatur Korporasi, Bengkel Umum Pelaku Usaha, Penerapan sanksi pidana maksimal dan perlindungan pengemudi angkutan barang; Budaya suap menyuap, tebang pilih dalam penindakan, sumber daya manusia yang tidak sadar hukum dan menyalahgunakan kekuasaan untuk kepentingan individu maupun kelompok dan pertanggungjawaban pidana dengan menitikberatkan pada unsur kesalahan berdasarkan konsep strict liability dan vicarious liability. | |||||||||
