Abstract
The land sale and purchase agreement that has been agreed upon by the Seller and the Buyer sometimes does not work according to the contents of the agreement which does not rule out the possibility of a dispute whose settlement ends in court. One of the examples in the case of the Banten High Court Decision Number 63 /PDT/2021/PT BTN, the Defendant at the Serang District Court level as the defeated party filed an appeal and at the appeal level at the Banten High Court gave a decision to cancel the decision of the Serang District Court on the grounds, the land sale and purchase agreement made violates the principle of decency. Identification of the problem in this study is how a violation of the principle of decency in the agreement can cancel the land sale and purchase agreement that has been agreed by both parties, and whether the cancellation of the decision of the District Court by the High Court on the grounds of violating the principle of propriety has provided justice for both parties in the case of Decision of the Banten High Court Number 63 /PDT/2021/PT BTN?. The theory used is the theory of agreement and the theory of justice. Normative juridical research methods using statutory, conceptual and case approaches The data sources used were secondary data consisting of primary, secondary and tertiary legal materials which were analyzed qualitatively. The results of the study show that: 1) Violation of the principle of propriety in the agreement can cancel the land sale and purchase agreement that has been agreed by the parties, on the condition that the agreement that has been agreed upon is actually a loan agreement with the pattern of a temporary land sale and purchase agreement. Thus, the agreement is considered to have violated the principle of decency, considering that based on the law of the agreement stipulated in Article 1320 of the Civil Code, subjective conditions are not fulfilled which according to law can be canceled by the Court. 2) With the cancellation of the District Court Decision by the High Court on the grounds that it violated the principle of decency, it has provided justice for both parties, where the legal consequences of the cancellation decision have returned to its original condition as if the Plaintiff and the Defendants had never entered into an agreement earlier as stated in Article 1265 of the Civil Code.

Salah satu contoh dalam kasus Putusan Pengadilan Tinggi Banten Nomor 63 /PDT/2021/PT BTN, pihak Tergugat di tingkat Pengadilan Negeri Serang sebagai pihak yang dikalahkan mengajukan banding dan pada tingkat banding di Pengadilan Tinggi Banten memberikan putusan membatalkan putusan Pengadilan Negeri Serang dengan alasan, perjanjian jual beli tanah yang dibuat melanggar asas kepatutan. Identifikasi masalah dalam penelitian ini adalah bagaimana pelanggaran asas kepatutan dalam perjanjian dapat membatalkan perjanjian jual beli tanah yang telah disepakati oleh ke dua belah pihak, dan apakah dengan dibatalkannya putusan Pengadilan Negeri oleh Pengadilan Tinggi dengan alasan melanggar asas kepatutan telah memberikan keadilan bagi ke dua belah pihak dalam kasus Putusan Pengadilan Tinggi Banten Nomor 63 /PDT/2021/PT BTN?. Teori yang digunakan adalah teori perjanjian dan teori keadilan. Metode penelitian yuridis normatif dengan menggunakan pendekatan undang-undang, konseptual dan pendekatan kasus Sumber data yang digunakan berupa data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier yang dianalisis secara kualitatif. Hasil penelitian menunjukan bahwa: 1) Pelanggaran asas kepatutan dalam perjanjian dapat membatalkan perjanjian jual beli tanah yang telah disepakati oleh para pihak, dalam kondisi bahwa perjanjian yang telah disepakati tersebut yang sebenarnya merupakan perjanjian pinjam meminjam dengan pola perjanjian jual beli tanah sementara. Sehingga, perjanjian tersebut dinilai telah melanggar asas kepatutan, mengingat berdasarkan pada hukum perjanjian yang diatur dalam Pasal 1320 KUHPerdata tidak terpenuhinya syarat subjektif yang menurut hukum dapat dibatalkan oleh Pengadilan. 2) Dengan dibatalkannya Putusan Pengadilan Negeri oleh Pengadilan Tinggi dengan alasan melanggar asas kepatutan telah memberikan keadilan bagi ke dua belah pihak, dimana akibat hukum dari putusan pembatalan tersebut telah mengembalikan kondisi dalam keadaan semula seolah-olah antara pihak Penggugat dengan Para Tergugat tidak pernah melakukan perjanjian sebelumnya sebagaimana yang disebutkan dalam Pasal 1265 KUHPer. | |||||||||
