Abstract

Banten Province has a local regulatory foundation that promotes the wellbeing of Banten's inhabitants for the past 22 years, ever since it was promulgated as a new autonomous area in 2000. The DPRD Regulation Number 1 of 2020 Concerning Orders specifies that the Banten Provincial DPRD, acting through the Regional Regulation Formation Agency (Bapemperda), is responsible for developing regional regulations. The first step in formulating a regional rule is the establishment of a program to facilitate its creation (propemperda). Prior to become a Propemperda, the Bapemperda must perform the duties and have the authority to perform the tasks necessary to harmonize, round up, and improve the draft regional regulations provided by members, commissions, or a combination of commissions. The research draws on the work of Charles O. Jones, whose theory of policy implementation states that three factors—"organization," "interpretation," and "application"—have an impact on how effectively policies are put into practice. This study employs a qualitative methodology, with expert informants participating in data gathering through interviews, observations, and written recording. According to O. Jones, the findings indicate that DPRD Regulation Number 1 of 2020 concerning Standing Orders has not been carried out as it should have been in practice. This is evident from the fact that the DPRD secretariat does not have a post dedicated to developing legislation. Each Bapemperda leader and member has their own unique take on what the role and responsibilities of Bapemperda are, and how those responsibilities and powers relate to the regionally mandated Propemperda. Research suggests that a Compiler of Draft Legislation be appointed to the functional position of Compiler of Draft Legislation in the Legislative Section, Budget Facilitation, and Oversight of the Bantayan (Regional Government) Department (DPRD), and that KPTA in the DPRD have a legal background and understand the preparation of legal products.

Additional Information: Sejak ditetapkan sebagai daerah otonom baru pada tahun 2000, Provinsi Banten telah memiliki landasan peraturan daerah yang mengedepankan kesejahteraan masyarakat Banten. Menurut Peraturan DPRD Nomor 1 Tahun 2020 tentang Tata Tertib, DPRD Provinsi Banten bertanggung jawab untuk membuat peraturan daerah melalui Badan Pembentukan Peraturan Daerah (Bapemperda). Menyusun program untuk memudahkan mereka berproduksi (propemperda) merupakan tahap awal dalam menyusun peraturan daerah. Untuk naik ke posisi Propemperda, Bapemperda terlebih dahulu harus memenuhi tanggung jawab dan menggunakan kewenangan yang diperlukan untuk mengoordinasikan, menyusun, dan menyempurnakan rancangan peraturan daerah yang disusun oleh anggota perseorangan, komisi, atau gabungan komisi. Berangkat dari karya Charles O. Jones, studi ini memperluas teorinya tentang implementasi kebijakan, yang mendalilkan bahwa "organisasi", "interpretasi", dan "implementasi" suatu kebijakan semuanya berperan dalam keberhasilan atau kegagalannya. dimasukkan ke dalam kenyataan. Telah ditetapkan melalui penyidikan bahwa Bagian Perundang-undangan, Fasilitasi Anggaran dan Pengawasan DPRD Bantayan mengangkat seorang Pembuat Rancangan Undang-Undang (RUU) ke dalam jabatan fungsional Penyusun Peraturan Perundang-undangan, dan KPTA di DPRD diabadikan dalam undang-undang. latar belakang dan keakraban dengan proses pembuatan dokumen hukum.
