Abstract

The background of this research is that the existence of forests is very important. Therefore, its existence must be developed and preserved so that it remains a source and life support for the nation and people of Indonesia. Forest exploitation activities, in the form of control over forest land and the practice of buying and selling forest land, are forms of activity that can cause environmental damage and are also contrary to statutory provisions. The identification of the research problem is how the legal status of tenure over land rights in the Nature Reserve Forest Area is reviewed based on Law no. 5 of 1960 concerning Basic Agrarian Regulations and Law no. 41 of 1999 concerning Forestry and how the legality of the practice of buying and selling land rights in the Lake Swamp Nature Reserve area of Serang Regency is based on Law no. 5 of 1960 concerning Basic Agrarian Regulations. The theory used is the theory of legal certainty and the theory of agreements, while the research method is qualitative with normative juridical and sociological juridical research types as supporting methods. The results of the study prove that the legal status of ownership rights over Nature Reserve land is carried out by the Central Government (Department of Forestry) in this case under the West Java Natural Resources Conservation Center (BBKSDA) section 1 Serang. So that the conclusion of land tenure by the community in the Lake Swamp Nature Reserve area is not in accordance with the provisions of Law no. 5 of 1960 and Law no. 41 of 1999. Then related to the validity of the practice of buying and selling land carried out in the Rawa Danau Nature Reserve area is not legal because it does not meet the elements of the legal requirements of buying and selling land which is carried out without a letter of ownership or authentic evidence and is carried out not before the PPAT. The suggestion from this research is that the government needs to hold legal counseling in an integrated manner and optimally review it by going directly to the field so as to raise public awareness about the type of land that is permissible and not to be owned.

Additional Information: Latar belakang penelitian ini yaitu bahwasannya keberadaan hutan sangat penting peranannya. Karenanya, wajib dikembangkan dan dilestarikan keberadaannya agar tetap menjadi sumber dan penunjang hidup bagi bangsa dan rakyat Indonesia. Kegiatan eksploitasi hutan, berupa penguasaan tanah hutan dan praktik jual beli tanah hutan merupakan bentuk-bentuk kegiatan yang dapat menimbulkan dampak kerusakan lingkungan juga bertentangan dengan ketentuan Perundang-undangan. Indentifikasi masalah penelitian ini adalah bagaimana status hukum penguasaan hak atas tanah di Kawasan Hutan Cagar Alam ditinjau berdasarkan UndangUndang No. 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria dan Undang-Undang No. 41 Tahun 1999 Tentang Kehutanan serta bagaimana keabsahan praktik jual beli hak atas tanah di kawasan Cagar Alam Rawa Danau Kabupaten Serang berdasarkan Undang-Undang No. 5 Tahun 1960 Tentang Peraturan Dasar Pokok-Pokok Agraria. Teori yang digunakan yakni teori kepastian hukum dan teori perjanjian, adapun metode penelitian adalah kualitatif dengan jenis penelitian yuridis normatif dan yuridis sosiologis sebagai metode pendukung. Hasil penelitian membuktikan bahwa status hukum penguasaan hak atas tanah Cagar Alam dilakukan oleh Pemerintah Pusat (Departemen Kehutanan) dalam hal ini berada dibawah Balai Besar Konservasi Sumber Daya Alam (BBKSDA) Jawa Barat seksi 1 serang. Sehingga kesimpulan penguasaan tanah oleh masyarakat dalam kawasan Cagar Alam Rawa Danau belum sesuai dengan ketentuan Undang-Undang No. 5 Tahun 1960 dan Undang-Undang No. 41 Tahun 1999. Kemudian terkait keabsahan praktik jual beli tanah yang dilakukan dikawasan Cagar Alam Rawa Danau tidaklah sah karena tidak memenuhi unsur syarat sahnya jual beli tanah yang dilakukan tanpa surat kepemilikan atau bukti autentik serta dilakukan tidak dihadapan PPAT. Saran dari penelitian ini yaitu pemerintah perlu mengadakan penyuluhan hukum secara terpadu dan meninjau secara optimal dengan langsung turun kelapangan agar menumbuhkan kesadaran masyarakat tentang jenis tanah yang boleh dan tidak untuk dimiliki.
