Abstract
Insurance Agents are supposed to act as representatives of insurance companies and are tasked with being financial consultants helping customers offer insurance products but Insurance Agents deliberately commit unlawful acts by embezzling a premiums of insured customers for their personal interests. The identification of the problem in this study is how the criminalization of the perpetrators of the criminal act of embezzlement of insurance premiums committed by insurance agents in Decision 706/Pid.Sus/2018/PN.Jkt Utr and how the basis for the judge's consideration in imposing a sentence on the perpetrators of the criminal act of embezzlement of insurance premiums by insurance agents in Decision 706/Pid.Sus/2018/PN.Jkt Utr. The theory that will be used by researchers in this study is to use a Punishment combined theory and the basic theory of judge consideration. This research method uses a normative juridical research type that uses statutory approaches and existing case studies. The results of the research obtained are that the punishment of Insurance Agents who commit the crime of embezzlement of insurance premiums is still not optimal because it is still far from the punishment threatened in the law so as to eliminate the nature of the deterrent effect and the loss of public protection. The judge should be able to apply the concept of the purpose of joint punishment so as to create community protection and deterrence for the recurrence of similar acts. Then in Decision 706/Pid.Sus/2018/PN.Jkt Utr the judge has provided the basis for his juridical considerations based on the prosecutor's indictment, witnesses and trial facts, but in terms of non-juridical considerations the judge did not fully consider this so that the judge only gave juridical considerations as a formality without not exploring, understanding the legal values and sense of justice that live in society. researcher suggestions are needed for firmer and optimal punishment in order to reduce the number of Insurance Agents who embezzle insurance premiums.

| Additional Information: | Agen Asuransi seharusnya bertindak sebagai perwakilan perusahaan asuransi dan bertugas menjadi konsultan finansial membantu nasabah menawarkan produk asuransi tetapi Agen Asuransi sengaja melakukan perbuatan melawan hukum dengan menggelapkan sejumlah premi nasabah tertanggung demi kepentingannya secara pribadi. Identifikasi Masalah dalam penelitian ini adalah bagaimana pemidanaan terhadap pelaku tindak pidana penggelapan Premi Asuransi yang dilakukan oleh Agen Asuransi pada Putusan 706/Pid.Sus/2018/PN.Jkt Utr dan Bagaimana dasar pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana penggelapan Premi asuransi oleh Agen Asuransi pada Putusan 706/Pid.Sus/2018/PN.Jkt Utr. Teori yang akan digunakan peneliti dalam penelitian ini yaitu menggunakan teori gabungan dan teori dasar pertimbangan hakim. Metode Penelitian ini menggunakan tipe penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan dan studi kasus yang ada. Hasil penelitian yang didapatkan yaitu pemidanaan terhadap Agen Asuransi yang melakukan tindak pidana penggelapan premi asuransi masih belum optimal kerena masih jauh dari pada pidana yang diancamkan dalam undang-undang sehingga menghilangkan sifat efek jera serta hilangnya perlindungan masyarakat. Seharusnya hakim dapat menerapkan konsep dari tujuan pemidanaan gabungan sehingga terciptanya perlindungan masyarakat dan daya cegah untuk terulangnya tindakan serupa. Lalu dalam Putusan 706/Pid.Sus/2018/PN.Jkt Utr hakim sudah memberikan dasar pertimbangan yuridisnya berdasarkan dakwaan jaksa, saksi dan fakta persidangan namun dalam hal pertimbangan secara non-yuridisnya hakim tidak sepenuhnya mempertimbangkan hal tersebut sehingga hakim hanya memberikan pertimbangan secara yuridis sebagai formalitas tanpa menggali, memahami nilai-nilai hukum dan rasa keadilan yang hidup dalam masyarakat. saran peneliti diperlukan pemidanaan yang lebih tegas dan optimal agar mengurangi banyaknya Agen Asuransi yang melakukan penggelapan premi asuransi. | |||||||||
