Abstract

Wages are one of the essential elements in an employment relationship, bearing in mind that wages are always associated with a source of income for workers to achieve a decent standard of living for themselves and their families. The current minimum wage setting policy within the framework of local government still encounters many obstacles as a result of not realizing a single wage uniformity, besides that there are also differences based on the level of ability, nature, and also the type of work in each company whose conditions are different. -different. The identification of the problem is, what is the authority of the Provincial Government regarding the implementation of the 2022 minimum wage setting? Then, what is the relevance of the implementation of the 2022 minimum wage setting carried out by the Provincial Regional Government to the principle of regional autonomy? The theory used is the theory of authority and the theory of decentralization. The concepts used are the concept of the regional government, the concept of regional autonomy, and the concept of wages. The research method used is normative juridical. The research specifications used are analytical descriptive. The data source used is secondary data supported by primary data. Data collection techniques were carried out through library research and field research. The data obtained were analyzed descriptively with a qualitative data analysis approach. The results of research regarding the authority of the Provincial Government regarding the implementation of the 2022 minimum wage determination show that the authority of the Provincial Government of the Special Capital Region of Jakarta has the authority in determining the 2022 minimum wage as stated in the legislation, even though the formula for calculating the 2022 minimum wage in the Regional Province Specifically for the capital city of Jakarta, it is not guided by Government Regulation Number 36 concerning Wages, but the governor's authority is attribution authority originating from statutory regulations. Therefore, there is a need for full constitutional and institutional strengthening to strengthen the authority of the Provincial Government in setting the minimum wage so that it can be properly accommodated for regional interests.

Additional Information:	Upah merupakan salah satu unsur esensial dalam Hubungan Kerja, mengingat keberadaan Upah selalu dikaitkan dengan sumber penghasilan bagi Buruh untuk mencapai derajat penghidupan yang layak bagi dirinya dan keluarganya. Kebijakan penetapan upah minimum dalam kerangka pemerintahan daerah dewasa ini masih menemui banyaknya kendala sebagai akibat belum terwujudnya satu keseragaman upah, selain itu juga masih terjadi perbedaan - perbedaan yang didasarkan pada tingkat kemampuan, sifat, dan juga jenis pekerjaan di masing-masing perusahaan yang kondisinya berbeda-beda. Adapun identifikasi masalahnya adalah, bagaimanakah kewenangan Pemerintah Daerah Provinisi terhadap pelaksanaan penetapan upah minimum Tahun 2022? Kemudian, bagaimanakah relevansi pelaksanaan penetapan upah minimun Tahun 2022 yang dilakukan oleh Pemerintah Daerah Provinsi terhadap prinsip otonomi daerah? Teori yang digunakan yaitu teori kewenangan dan teori desentralisasi, Adapun konsep yang digunakan ialah konsep pemerintahan daerah, dan konsep otonomi daerah dan konsep upah. Metode penelitian yang digunakan adalah yuridis empiris. Spesifikasi penelitian yang digunakan yaitu deskriptif analitis. Sumber data yang digunakan yaitu data sekunder yang ditunjang oleh data primer. Teknik pengumpulan data dilakukan dengan penelitian kepustakaan dan penelitian lapangan. Data yang diperoleh dianalisis secara deskriptif dengan pendekatan analisis data kualitatif. Hasil penelitian mengenai kewenangan Pemerintah Daerah Provinisi terhadap pelaksanaan penetapan upah minimum Tahun 2022 menunjukkan bahwa kewenangan Pemerintah Daerah Provinsi Daerah Khusus Ibukota Jakarta memiliki kewenangan dalam penetapan upah minimum Tahun 2022 sebagaimana tercantum dalam peraturan perundag-undangan, meskipun formulasi perhitungan upah minimum Tahun 2022 di Provinsi Daerah Khusus Ibukota Jakarta tidak berpedoman pada Peraturan Pemerintah Nomor 36 tentang Pengupahan namum kewenangan yang dimiliki gubernur merupakan kewenangan atribusi yang bersumber dari peraturan perundag-undangan. Oleh karena itu, perlu adanya penguatan penuh secara konstitusi maupun lembaga untuk memperkuat kewenangan Pemerintah Daerah Provinsi dalam penetapan upah minimum agar dapat terakomodir dengan baik untuk kepentingan daerah dan buruh.
