Abstract
This thesis discusses the occupational safety and health management system of PT Karya Baja Tama, there are problems in the implementation system, namely violations of not complying with applicable regulations. Identification of the problem in this study is how the occupational safety and health management system (SMK3) for factory workers in the industria. sector of PT. Karya Baja Tama is reviewed based on Law Number 1 of 1970 concerning Work Safety and how the management of PT. Karya Baja Tama ensures an Occupational Safety and Health (SMK3) system for workers according to Law Number 1 of 1970 Concerning Occupational Safety. The theory used in this study is the theory of legal protection. This research was conducted using normative juridical and empirical juridical methods. The normative juridical research approach uses statutory regulations. Meanwhile, the empirical juridical research approach uses legal studies in society. The data sources used in this study are primary data sources and secondary data which are then analyzed qualitatively. The results of this study are that first, the implementation of the occupational safety and health management system has not been maximally implemented by PT Karya Baja Tama, because PT Karya Baja Tama's SOP still has several weaknesses, namely not balancing between the rules contained in Law Number 1 of 1970 concerning work safety ; and there is no SOP that regulates sanctions if workers do not use the complete K3 attributes; So that companies and workers are suspected of not complying with applicable regulations. The settlement mechanism if the worker has an accident can be carried out through the settlement of the industrial relations court and resolves it with the family party with the responsibility for the cost of loading if an accident occurs borne by the company. This research concludes that the legal protection for workers is not maximized. PT Karya Baja Tama is less responsive in the process of implementing an occupational health and safety management system. So the suggestions in this study are that it is hoped that PT Karya Baja Tama will improve protection for workers by supervising through a special team in the work area and be more responsive to oversight of the occupational safety and health management system.

| Additional Information: | Skripsi ini membahas mengenai sistem manajemen Keselamatan dan Kesehatan kerja PT Karya Baja Tama, terdapat permasalahan dalam sistem penerapannya yaitu pelanggaran tidak menjalankan sesuai peraturan yang berlaku. Identifikasi masalah dalam penelitian ini adalah bagaimana perlindungan sistem manajemen Keselamatan dan Kesehatan kerja (SMK3) terhadap buruh pabrik sektor industri di PT. Karya Baja Tama ditinjau berdasarkan Undang-Undang Nomor 1 tahun 1970 Tentang Keselamatan Kerja dan bagaimana mekanisme yang ditempuh PT. Karya Baja Tama atas terjadinya ketidaksesuaian sistem Keselamatan dan Kesehatan Kerja (SMK3) pada pekerja menurut Undang-Undang Nomor 1 Tahun 1970 Tentang Keselamatan Kerja. Teori yang digunakan dalam penelitian ini adalah teori perlindungan hukum. Penelitian ini dilakukan dengan metode yuridis normatif dan yuridis empiris. Metode yuridis normatif pendekatan penelitian menggunakan peraturan perundang-undangan. Sedangkan yuridis empiris pendekatan penelitian menggunakan kajian hukum di dalam masyarakat. Sumber data yang digunakan dalam penelitian ini adalah sumber data primer dan data sekunder yang kemudian dianalisis secara kualitatif. Hasil penelitian ini yaitu pertama penerapan sistem manajemen Keselamatan dan Kesehatan kerja masih belum maksimal diterapkan oleh PT Karya Baja Tama, karena SOP PT Karya Baja Tama masih memiliki beberapa kelemahan yaitu tidak balances antara aturan yang terdapat pada Undang-undang Nomor 1 Tahun 1970 tentang Keselamatan kerja ; dan tidak terdapat SOP yang mengatur mengenai sanksi jika pekerja tidak memakai dengan lengkap atribut K3; Sehingga perusahaan dan pekerja diduga tidak menaati peraturan yang berlaku. Mekanisme penyelesaian apabila pekerja kecelakaan dapat dilakukan melalui penyelesaian pengadilan hubungan industri dan menyelesaikannya degan pihak kekeluargaan dengan tanggungan biaya pengobatan bila terjadi kecelakaan ditanggung oleh perusahaan. Penelitian ini menghasilkan kesimpulan bahwa perlindungan hukum terhadap pekerja belum maksimal PT Karya Baja Tama kurang responsif dalam proses penerapan sistem manajemen Keselamatan dan Kesehatan kerja. Sehingga saran dalam penelitian ini diharapkan PT Karya Baja Tama meningkatkan perlindungan bagi pekerja dengan melakukan supervisi melalui tim khusus pada area kerja dan lebih responsif terhadap pengawasan sistem manajemen Keselamatan dan Kesehatan kerja. | |||||||||
