Abstract

The basis for the lawsuit decision was unacceptable, because the defendant filed an exception or response to the lawsuit whose reasons were considered by the Judge. Identification of the problems in this study, first, what are the normative legal standing criteria based on formal law and material law in filing a lawsuit to the court; secondly, is the Judge's consideration in the Decision of the Tangerang District Court Number: 788/Pdt.G/2020/PN.Tng. stated that the Plaintiff's claim was unacceptable in accordance with applicable law. The theory used in this study is the theory of legal certainty. This study uses a normative juridical method. The source of data used in this research is secondary data supported by primary data, namely interviews which are then analyzed qualitatively. From the results of this study it can be concluded, firstly the normative criteria for legal standing of material civil law, concerning the legal basis for a party to have legal standing in filing a lawsuit to the Court through the Non-Governmental Organization for Consumer Protection, as stipulated in Article 46 paragraph (1) of the Law -Law Number 8 of 1999, Government Regulation Number 59 of 2001, and Decree of the Minister of Industry and Trade Number 302/MPP/Kep/10/2001. However, the intention of representing in this Law is that the Non-Governmental Consumer Protection Agency can directly act as a principal, namely a person who has his own legal interests and not as a legal representative; secondly on the Decision of the Tangerang District Court Number: 788/Pdt.G/2020/PN.Tng., Yaperma cannot go to court because the law does not give authority to legal entities to go to court to become legal counsel, but can represent the interests of other people people who do not have the ability to act, and Yaperma already has legal standing in filing a lawsuit in court. Suggestions in this study are that the Plaintiff, in this case the Non-Governmental Consumer Protection Agency, apart from having to have legal standing, presumably need to understand the proceedings in court and the judges must have the courage to make legal breakthroughs to acknowledge and procedurally accept legal standing lawsuits.

Identifikasi masalah dalam penelitian ini, pertama bagaimana kriteria normatif legal standing berdasarkan hukum formil maupun hukum materiil dalam mengajukan gugatan ke Pengadilan; kedua apakah pertimbangan Hakim dalam Putusan Pengadilan Negeri Tangerang Nomor: 788/Pdt.G/2020/PN.Tng. menyatakan gugatan Penggugat tidak dapat diterima telah sesuai dengan hukum yang berlaku. Teori yang digunakan dalam penelitian ini adalah teori kepastian hukum. Penelitian ini menggunakan metode yuridis normatif. Sumber data yang digunakan dalam penelitian ini adalah data sekunder yang didukung oleh data primer yaitu wawancara yang kemudian di analisis secara kualitatif. Dari hasil penelitian ini dapat diperoleh kesimpulan, pertama kriteria normatif legal standing hukum perdata materiil, menyangkut tentang dasar hukum agar suatu pihak dapat memiliki legal standing dalam mengajukan gugatan ke Pengadilan melalui LPKSM, sebagaimana diatur dalam Pasal 46 ayat (1) Undang-Undang No. 8 Tahun 1999, Peraturan Pemerintah No. 59 Tahun 2001, dan Keputusan Menteri Perindustrian dan Perdagangan No. 302/MPP/Kep/10/2001. Namun, maksud mewakili dalam Undang-Undang ini adalah bahwa LPKSM tersebut dapat langsung bertindak sebagai principal, yaitu orang yang memiliki kepentingan hukum sendiri dan bukan sebagai kuasa hukum; kedua pada Putusan Pengadilan Negeri Tangerang Nomor: 788/Pdt.G/2020/PN.Tng., Yaperma tidak dapat maju ke Pengadilan karena hukum tidak memberikan wewenang kepada badan hukum untuk maju ke Pengadilan untuk menjadi kuasa hukum, tetapi dapat mewakili kepentingan orang-orang yang tidak mempunyai kemampuan untuk bertindak, dan Yaperma telah memiliki legal standing dalam mengajukan gugatan ke Pengadilan. Saran dalam penelitian ini adalah Penggugat dalam hal ini LPKSM, selain harus mempunyai legal standing, kiranya perlu paham mengenai beracara di Pengadilan dan para Hakim harus berani melakukan terobosan hukum untuk mengakui dan menerima secara prosedural gugatan legal standing.
