Abstract

Failure to uphold justice is when a law enforcer (investigator) who has the power and authority to strive for justice actually uses the power and authority that is in him to provide injustice. Failure to uphold justice is an act that reduces or limits a person's freedom, so that person must uphold the value of human rights. Human rights are the basis for everyone to receive fair treatment even though someone has committed a criminal act, he must be treated as an innocent person even though based on the evidence he is guilty, as long as there is no court decision. Identification of the problem in this study is about how the process of handling investigators who commit miscarriages of justice and how criminal accountability by investigators is due to the occurrence of miscarriages of justice. Then, the theory used in this research is law enforcement theory and criminal responsibility theory. Furthermore, the research method used in this thesis is a normative juridical research method that is analytically descriptive in nature, meaning research on the application of criminal law through the criminal responsibility of an investigator who fails to uphold justice. Investigators have the potential to commit criminal acts if these actions are not in accordance with procedures during the investigation process. Regarding the failure to uphold justice which results in people who are even sentenced to criminal sentences but do not commit their actions, the investigator is handled by Bidpropam in accordance with Perkapolri No. 7 of 2022 concerning the Code of Ethics and the Police Ethics Commission. Conclusions and suggestions, investigators must be criminally responsible for depriving a person's right to independence and the investigator can be held criminally accountable if the investigator's actions are not in accordance with the procedure and the procedure is wrong in such a way and has even gone out and deviated from the purpose of the investigation, re-enacted by the judge commissioners or wasma judges who can change decisions that are absolute in court decisions.

Additional Information:	Kegagalan penegakan keadilan adalah apabila seorang penegak hukum (penyidik) yang mempunyai kekuasaan dan kewenangan untuk mengupayakan tercapainya keadilan, ternyata justru menggunakan kekuasaan dan kewenangan yang ada padanya untuk memberikan ketidakadilan. Kegagalan penegakan keadilan merupakan suatu tindakan yang mengurangi atau membatasi kemerdekaan seseorang, maka terhadap seseorang itu harus dijunjung tinggi nilai HAM. HAM yang menjadi dasar setiap orang untuk mendapat perlakuan wajar walaupun seseorang telah melakukan perbuatan tindak pidana, ia harus diperlakukan sebagai pribadi yang tidak bersalah meskipun berdasarkan bukti-bukti yang ada ia bersalah, selama belum ada keputusan pengadilan. Identifikasi masalah pada penelitian ini adalah tentang bagaimana proses penanganan terhadap penyidik yang melakukan miscarriage of justice dan bagaimana pertanggungjawaban pidana oleh penyidik akibat terjadinya miscarriage of justice. Kemudian, teori yang digunakan pada penelitian ini adalah teori penegakan hukum dan teori pertanggungjawaban pidana. Selanjutnya, metode penelitian yang digunakan dalam skripsi ini ialah metode penelitian yuridis normatif yang bersifat deskriptif analitis, artinya penelitian penerapan hukum pidana melalui pertanggungjawaban pidana seorang penyidik yang melakukan kegagalan penegakan keadilan. Penyidik berpotensi melakukan tindak pidana bila tindakan tersebut tidak sesuai dengan prosedur pada saat proses penyidikan. Terhadap kegagalan penegakan keadilan yang mengakibatkan orang yang bahkan dijatuhi hukuman pidana tetapi tidak melakukan perbuatannya, penyidik tersebut ditangani oleh Bidpropam sesuai dengan Perkapolri No 7 Tahun 2022 tentang Kode Etik dan Komisi Etik Kepolisian. Kesimpulan dan saran, Penyidik harus melakukan pertanggungjawaban secara pidana karena telah merampas hak kemerdekaan seorang tersebut dan penyidik dapat dipertanggungjawabkan secara pidana bilamana tindakan penyidik tersebut tidak sesuai dengan prosedur dan kesalahan prosedur tersebut sedemikian rupa dan bahkan sudah keluar dan menyimpang dari tujuan penyidikan, diberlakukan kembali hakim komisaris atau hakim wasma yang dapat merubah keputusan yang mutlak pada putusan pengadilan.
