Abstract
Child care or child custody is often a problem in divorce, especially divorcement in mixed marriages. Children may become victims of abduction by one of their parents or their own family outside their habitual residence (International Child Abduction). The problems of this research are, first, How is the arrangement of child custody due to divorce in a marriage of different nationalities related to the 1980 Hague Convention Concerning Civil Aspects of International Child Abduction in the case study of child custody resulting from a divorce of different nationalities between Yeane Sailan and Dennis Kellet? Second, How is the implementation of the 1980 Hague Convention Concerning Civil Aspects of International Child Abduction in the case study of child custody resulting from a divorce of different nationalities between Yeane Sailan and Dennis Kellet? The theory used is the Theory of Legal Protection and Theory of the Principle of Domicile. The research method used in the preparation of this thesis uses the juridical-normative method with the research approach used is secondary data using a descriptive analysis approach, the data collection technique carried out by the author in this study is through library research. The data analysis used is a qualitative approach. The results of this study are first, the regulation of child custody due to divorce in marriages of different nationalities is regulated in Law No. 1 of 1974 Articles 41-49, Compilation of Islamic Law Articles 98-106, the United Nations Convention on the Rights of the Child in the Child Protection Act. and Law Number 12 of 2006. Second, Indonesia has not ratified the 1980 Hague Convention so that the implementation of the 1980 Hague Convention in the Case Study of Child Custody Due to Divorce of Different Citizens Between Yeane Sailan and Dennis Kellet cannot be carried out properly. In this case, Indonesia is expected to be able to ratify the 1980 Hague Convention, so that if a similar case occurs, it can be resolved appropriately and quickly.

Adapun masalah dari penelitian ini adalah, Pertama, Bagaimana pengaturan hak asuh anak akibat perceraian dalam perkawinan beda kewarganegaraan dihubungkan dengan Konvensi Den Haag 1980 Tentang Aspek-Aspek Sipil Penculikan Anak Internasional dalam studi kasus hak asuh anak akibat perceraian beda kewarganegaraan antara Yeane Sailan dan Dennis Kellet? Kedua, Bagaimana implementasi Konvensi Den Haag 1980 Tentang Aspek-Aspek Sipil Penculikan Anak Internasional dalam studi kasus hak asuh anak akibat perceraian beda kewarganegaraan antara Yeane Sailan dan Dennis Kellet?. Teori yang digunakan Teori Perlindungan Hukum dan Teori Asas Domisili. Metode penelitian yang digunakan dalam penyusunan skripsi ini menggunakan metode Yuridis-Normatif dengan pendekatan penelitian yang digunakan adalah data sekunder dengan menggunakan pendekatan Deskriptif Analisis, teknik pengumpulan data yang dilakukan penulis dalam penelitian ini adalah melalui studi kepustakaan. Analisis data yang dipergunakan adalah pendekatan kualitatif. Adapun hasil penelitian ini adalah pertama, pengaturan hak asuh anak akibat perceraian dalam perkawinan beda kewarganegaraan diatur dalam Konvensi PBB Tentang Hak Anak, Konvensi Den Haag 1980, Undang-Undang No 1 Tahun 1974 Pasal 41-49, Undang-Undang Nomor 12 Tahun 2006 Tentang Kewarganegaraan Republik Indonesia, dan Kompilasi Hukum Islam. Kedua, Indonesia belum meratifikasi Konvensi Den Haag 1980 sehingga implementasi Konvensi Den Haag 1980 dalam Studi Kasus Hak Asuh Anak Akibat Perceraian Beda Kewarganegaraan Antara Yeane Sailan dan Dennis Kellet tidak dapat dilakukan dengan baik. Saran penulis, Indonesia diharapkan bisa meratifikasi Konvensi Den Haag 1980, sehingga apabila terjadi kasus serupa dapat diselesaikan dengan tepat dan cepat. | |||||||||
