Abstract

Musik merupakan suatu unsur yang sangat penting di sebuah kedai kopi, khususnya di Kota Serang. Hak cipta atas musik telah diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan diatur lebih lanjut lagi dalam Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Lagu dan atau Musik. Namun walaupun telah ada peraturan yang mengatur tentang hak cipta musik, banyak coffe shop yang memutar musik untuk membangun suasana tanpa membayar royalti kepada pencipta dan pemilik hak terkait dikarenakan mereka merasa keberatan dengan harga yang dinilai cukup tinggi dan tidak adanya itikad baik dari LMKN selaku lembaga yang mengurus hal ini, itikad baik yang dimaksud adalah sosialisasi terkait peraturan tersebut. Identifikasi masalah yaitu, bagaimana penerapan atas pengaturan royalti hak cipta atas lagu dan musik di Kota Serang dan bagaimana penyelesaian atas permasalahan yang di hadapi oleh user terkait kesiapan dalam penerapan atas pengelolaan royalti hak cipta lagu di Kota Serang. Teori yang digunakan adalah teori kemanfaatan dan teori sistem hukum. Metode penelitian yang digunakan yaitu penelitian hukum normatif empiris, dengan pendekatan yang digunakan adalah pendekatan studi keberlakuan hukum. Sumber data yang digunakan adalah data sekunder dan data primer dengan teknik pengumpulan data studi pustaka dan studi lapangan serta dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukan bahwa dalam hal kesiapan user di Kota Serang untuk performing rights belum berjalan sebagaimana semestinya, dikarenakan ketidaktahuan Coffee Shop terhadap peraturan tersebut walaupun musik sejatinya merupakan komponen yang mereka anggap harus ada terdapat ketidaksetujuan dari pihak yang mana user merasa keberatan dengan harga yang dharus dibayarkan, tidak adanya sosialisasi juga makin membuat pihak coffe shop enggan membayar royalti tersebut. Tidak adanya ketegasan dari LMKN juga membuat peraturan ini tidak berjalan sebagaimana semestinya. Coffe Shop tersebut juga lebih memilik untuk tidak memutar lagu sama sekali daripada harus membayar sejumlah royalti tersebut, atau mendatangkan musisi lokal untuk membawakan karyanya sendiri. LMKN selaku lembaga yang mengurus hal ini seharusnya lebih siap dalam melaksanakan peraturan ini seperti melakukan sosialisasi baik secara langsung maupun virtual serta coffee shop di Kota Serang seharusnya mengungkapkan rasa keberatannya secara langsung kepada LMKN selaku lembaga yang mengurus hal tersebut.

Additional Information:	Music is a very important element in a coffee shop, especially in the city of Serang. Copyright for music is regulated in Law Number 28 of 2014 concerning Copyright and further regulated in Government Regulation Number 56 of 2021 concerning Management of Song and or Music Royalties. However, even though there are regulations governing music copyright, many coffee shops play music to build an atmosphere without paying royalties to creators and related rights owners because they object to the price being considered quite high and there is no good will from LMKN as the institution that dealing with this matter, the good faith in question is socialization related to these regulations. Identification of the problem, namely, how to implement the regulation of copyright royalties for songs and music in Serang City and how to resolve the problems faced by users related to readiness in implementing the management of song copyright royalties in Serang City. The theory used is the theory of expediency and the theory of the legal system. The research method used is empirical normative legal research, with the approach used is the study of law enforcement. Sources of data used are secondary data and primary data with data collection techniques literature study and field study and analyzed descriptively qualitatively. The results of the study show that in terms of the readiness of users in Serang City to perform rights, it has not proceeded as it should, due to the Coffee Shop's ignorance of these regulations, even though music is actually a component that they think must exist, there is disagreement from parties where users object to the price that must be paid , the absence of socialization also makes the coffee shop more reluctant to pay the royalty. The lack of firmness from LMKN also makes this regulation not work as it should. The Coffee Shop also prefers not to play any songs at all rather than having to pay that amount of royalties, or bringing in local musicians to perform their own work. LMKN as the institution that takes care of this matter should be more prepared in implementing this regulation such as conducting socialization both in person and virtually as well as coffee shops in Serang City should express their objections directly to LMKN as the institution that takes care of this matter.
