Abstract
Demonstrations are common things that are done by a person or group to oppose the policies of the government or authorities that are not in accordance with what is in society, freedom to express thoughts and opinions is a human right that cannot be eliminated and must be respected. The Indonesian people have voted and are determined to protect the freedom to express these thoughts and opinions in the 1945 Constitution, The right of citizens to express opinions in public is indeed protected by the constitution, namely in Article 28E of the Constitution. However, violence still occurred against demonstrators, one example of which was Dede Lutfi Alfiandi and also Faris Amrullah, a UIN student who was slammed by a member of the Tangerang Police. Based on this background, the problems studied in this study are: How is law enforcement against police officers who commit acts of violence against demonstrators? and How is the legal protection for victims of violence during demonstrations?. This study uses a qualitative normative juridical method. The results of the analysis in this study show that there are still police officers who violate the code of ethics and discipline and also commit violence against demonstrators during riots during countermeasures against demonstrations. Law enforcement against police officers must be paid more attention and emphasized for the good image of the police, legal protection for victims must be considered by related institutions such as the National Human Rights Commission, the LPSK and especially the police

| Additional Information: | Demonstrasi adalah hal biasa yang dilakukan seseorang atau kelompok untuk menentang kebijakan kebijakan pemerintah atau penguasa yang tidak sesuai dengan apa yang ada di masyarakat, kemerdekaan menyatakan pikiran dan pendapat merupakan Hak Asasi Manusia yang tidak dapat dihilangkan dan harus dihormati. Rakyat Indonesia telah memilih dan berketetapan hati melindungi kemerdekaan menyatakan pikiran dan pendapat itu dalam Undang-Undang Dasar 1945, Hak warga Negara untuk menyampaikan pendapat di muka umum memang dilindungi oleh konstitusi, yakni dalam UUD Pasal 28E Namun masih terjadi kekerasan terhadap demonsran yang salah satu contohnya yaitu Dede Lutfi Alfiandi dan juga Faris Amrullah mahasiswa UIN yang dibanting oleh oknum Kepolisian Polres Tangerang. Berdasarkan latar belakang tersebut, permasalahan yang dikaji dalam penelitian ini yaitu: Bagaimana penegakan hukum terhadap oknum kepolisian yang melakukaan tindak pidana kekerasan terhadap demonstran? dan Bagaimana perlindungan hukum bagi korban kekerasan saat melakukan demonstrasi?. Penelitian ini menggunakan metode yuridis normatif yang bersifat kualitatif. Hasil analisa pada penelitian ini bahwa masih ada Oknum kepolisian yang melanggar kode etik dan disiplin dan juga melakukan kekerasan terhadap demonstran saat terjadi kerusuhan pada saat penanggulangan demonstrasi, Penegakan hukum terhadap Oknum kepolisian harus lebih diperhatikan lagi dan dipertegas demi citra baik Polri, perlindungan hukum terhadap korban harus diperhatikan oleh lembaga lembaga terkait seperti Komnas HAM, LPSK dan terkhusus Kepolisian. | |||||||||
