Abstract
The 1945 Constitution affirms that the Republic of Indonesia is a state based on law (rechtstaat). In Indonesia, in order to uphold the rule of law as aspired to, it is necessary to make efforts so that the public is familiar with the intricacies of the applicable law. The problem is first, how is the legal protection for smartphone users in the International Mobile Equipment Identity (IMEI) validation process. Second, how are the government's efforts towards smartphone supervision authority in the International Mobile Equipment Identity (IMEI) validation process. The theory used is the theory of legal protection and the theory of authority. The research method is normative legal research. The research specification used is a normative approach. Sources of data are research in the form of primary data and secondary data. Data collection techniques are carried out by data library studies and data field studies. The data obtained in this paper using qualitative analysis is a technique of collecting data from direct interviews by distributing questionnaires that are carried out by the author directly. The results of the study can be concluded, that all IMEI data must be registered with the EIR owned by cellular operators, and also the EIR owned by the Ministry of Industry. This is to provide a protection mandate as stated in Article 1 Paragraph (2) of Law Number 27 of 2022 concerning Protection of Personal Data. Second, the Government's efforts towards Smartphone Supervision Authority in the Validation Process of International Mobile Equipment Identity (IMEI). IMEI control process in Indonesia using the White List scheme. The advice given by the author is that the government must be more assertive in its efforts to provide legal protection for smartphones in the IMEI process in order to protect users from crime and the Government must use the International Mobile Equipment Identity (IMEI) element as a condition for activation.

| Additional Information: | Undang-Undang Dasar 1945 menegaskan bahwa negara Republik Indonesia adalah negara yang berdasarkan atas hukum (rechtstaat). Di Indonesia dalam rangka menegakkan negara hukum sebagaimana yang dicita-citakan, perlu dilakukan usaha-usaha agar masyarakat mengenal seluk-beluk hukum yang berlaku. Masalahnya adalah pertama, bagaimana perlindungan hukum terhadap masyarakat pengguna smartphone dalam proses validasi International Mobile Equipment Identity (IMEI). Kedua, bagaimana upaya pemerintah terhadap kewenangan pengawasan smartphone dalam proses validasi International Mobile Equipment Identity (IMEI). Teori yang digunakan yaitu teori perlindunga hukum dan teori kewenangan. Metode penelitian yaitu penelitian hukum normatif. Spesifikasi penelitian yang digunakan yaitu pendekatan normatif. Sumber data yaitu penelitian yang berupa data primer dan data sekunder. Teknik pengumpulan data dilakukan dengan studi kepustakaan data dan studi lapangan data. Data diperoleh pada penulisan ini menggunakan analisis kualitatif merupakan teknik pengambilan data dari wawancara langsung dengan membagikan kuesioner yang dilakukan penulis secara langsung. Hasil penelitian mengenai perlindungan hukum terhadap masyarakat pengguna smatrphone dalam proses International Mobile Equipment Identity (IMEI) bahwa semua data IMEI harus terdaftar pada EIR yang dimiliki oleh operator seluler, dan juga EIR yang dimiliki oleh kemenperin. Hal ini untuk memberikan amanat perlindungan sebagaimana Pasal 1 Ayat (2) UU Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi. Kedua, upaya Pemerintah Terhadap Kewenangan Pengawasan Smartphone Dalam Proses Validasi International Mobile Equipment Identity (IMEI) proses pengendalian IMEI di Indonesia menggunakan skema White List. Kesimpulannya bahwa pemerintah telah melakukan perlindungsan kepada masyarakat yang memiliki IMEI secara legal melalui EIR dan CEIR yang terdaftar di Kementerian Perindustrian. Saran yang diberikan penulis adalah pemerintah harus lebih tegas lagi dalam upaya memberikan perlindungan hukum smatrphone dalam proses IMEI guna melindungi pengguna dari kejahatan dan Pemerintah harus menggunakan unsur International Mobile Equipment Identity (IMEI) sebagai syarat aktivasi. | |||||||||
