Abstract

Recording of name changes in population documents requires a stipulation by the District Court where the applicant is based, based on Article 53 of Presidential Regulation Number 96 the year of 2018 concerning Requirements and Procedures for Resident Registration and Civil Registration, a copy of the district court's stipulation is a requirement for recording a name change. As for the identification of the problem, how is the legal review of the recording of name changes in population documents as personal status and the legal status of Indonesian citizens case study decision number: 155/Pdt.P/2021/PN Srg, and how is the procedure for recording name changes in population documents as personal status and legal status of Indonesian citizens case study of decision number: 155/Pdt.P/2021/PN Srg. The theory used is, the theory of public service and legal certainty theory The method used in this research is normative juridical with data analysis through a qualitative approach using secondary data. The research results legal review of the recording of the registration of name changes in population documents in decision number: 155/Pdt.P/2021/PN Srg is in accordance with Article 52 paragraph (1) of Law Number 23 of 2006 concerning Population Administration, namely that every change of identity must be based on a stipulation District Court according to the applicant's domicile, name changes made due to data errors in population documents, issuance of population documents that were carried out inadvertently led to data errors. Conclusion of the decision of the Serang Court Number: 155/Pdt.P/2021/PN Srg as the basis for determining the actual data on the population document that will be changed, the issuance of population documents that is not careful and not in accordance with procedures causes data errors in it so that it will not provide legal certainty for the owner. Suggestions, for issuing population documents should be done properly to be more careful, the prudence of residents and the Population and Civil Registration Service is very important to avoid data errors.

Additional Information:	Pencatatan perubahan nama dalam dokumen kependudukan memerlukan adanya penetapan Pengadilan Negeri tempat pemohon, berdasarkan Pasal 53 Peraturan Presiden Nomor 96 Tahun 2018 tentang Persyaratan dan Tata Cara Pendaftaran Penduduk dan Pencatatan Sipil, salinan penetapan pengadilan negeri menjadi syarat dalam pencatatan perubahan nama. Adapun identifikasi masalahnya, bagaimana tinjauan hukum terhadap pencatatan perubahan nama dalam dokumen kependudukan sebagai status pribadi dan status hukum warga negara Indonesia studi kasus putusan nomor : 155/Pdt.P/2021/PN Srg, dan bagaimana prosedural pencatatan perubahan nama dalam dokumen kependudukan sebagai status pribadi dan status hukum warga negara Indonesia studi kasus putusan nomor : 155/Pdt.P/2021/PN Srg. Teori yang digunakan yaitu, teori pelayanan publik dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini yuridis normatif dengan analitis data melalui pendekatan kualitatif yang menggunakan data sekunder. Hasil penelitian tinjauan hukum terhadap pencatatan pencatatan perubahan nama dalam dokumen kependudukan pada putusan nomor : 155/Pdt.P/ 2021/PN Srg telah sesuai dengan pasal 52 ayat (1) Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan yaitu setiap perubahan identitas harus berdasarkan penetapan Pengadilan Negeri sesuai domisili pemohon, perubahan nama yang dilakukan karena adanya kesalahan data pada dokumen kependudukan, penerbitan dokumen kependudukan yang dilakukan secara tidak hati-hati menyebabkan adanya kesalahan data. Kesimpulan penetapan Pengadilan Serang Nomor : 155/Pdt.P/2021/PN Srg sebagai dasar untuk menetapkan data yang sebenarnya pada dokumen kependudukan yang akan diubah, penerbitan dokumen kependudukan yang tidak hati-hati dan tidak sesuai dengan prosedur menyebabkan adanya kesalahan data didalamnya sehingga tidak akan memberikan kepastian hukum bagi pemiliknya. Saran, penerbitan dokumen kependudukan seharusnya dilakukan dengan lebih hati-hati, kehati-hatian warga dan Dinas Kependudukan dan Pencatatan Sipil sangatlah penting guna menghindari adanya kesalahan data.
