Abstract
From year to year the number of victims of traffic accidents continues to creep up. This Law Number 34 of 1964 concerning Road Traffic Accident Funds must be understood from the perspective of social security. Social security itself is an effort by the state to provide basic protection for the community in order to fulfill a decent life so that the compensation provided is relatively not so large. The compensation fund was obtained from PT. Services Raharja Banten Branch. Researchers are interested in examining how the process of implementing compensation compensation for PT. Jasa Raharja Banten Branch for victims of road traffic accidents is related to Law Number 34 of 1964 concerning Juncto Road Traffic Accident Funds Government Regulation Number 18 of 1965 concerning Provisions for Implementation of Road Traffic Accident Funds? and how the legal protection of PT. Jasa Raharja Banten Branch for single accident victims is related to Law Number 34 of 1964 concerning Juncto Road Traffic Accident Fund Government Regulation Number 18 of 1965 concerning Provisions for Implementation of Road Traffic Accident Fund? The theory used is the Theory of Legal Assurance and Theory of Legal Protection. The research method used is normative juridical, with a statutory approach and a case approach, the data sources are primary and secondary data, Data collection techniques in the form of literature study, interviews and observations and data analysis in the form of qualitative analysis. The results of the study are the traffic accident insurance claim process at PT Asuransi Jasa Raharja, namely filling out the application form by attaching: Traffic accident information from the police, information from the doctor, ID card / identity of the victim / victim's heirs. Victims of single traffic accidents do not receive compensation because in accordance with Law Number 33 of 1964 and Law Number 34 of 1964 they are not entitled to receive compensation. Single accident which is meant by a single accident victim is that there is absolutely no contact with other vehicles. Then legal protection for victims of a single traffic accident at PT Jasa Raharja Insurance for victims who die from a single accident, PT Jasa Raharja provides units. The amount of compensation depends on the policy of the leadership. For a single accident with minor injuries and fractures, PT Jasa Raharja cannot claim it

Undang- Undang Nomor 34 Tahun 1964 Tentang Dana Kecelakaan Lalu Lintas Jalan ini harus dipahami dari perspektif jaminan sosial. Jaminan sosial sendiri merupakan upaya negara memberi perlindungan dasar bagi masyarakat agar memenuhi kehidupan yang layak sehingga santunan yang diberikan relatif tidak begitu besar. Dana santunan diperoleh dari PT. Jasa Raharja Cabang Banten. Peneliti tertarik untuk meneliti bagaimana proses pelaksanaan pemberian santunan ganti rugi PT. Jasa Raharja Cabang Banten terhadap korban kecelakaan lalu lintas jalan dihubungkan dengan Undang- Undang Nomor 34 Tahun 1964 Tentang Dana Kecelakaan Lalu Lintas Jalan Juncto Peraturan Pemerintah Nomor 18 Tahun 1965 Tentang Ketentuan- Ketentuan Pelaksanaan Dana Kecelakaan Lalu Lintas Jalan? dan bagaimana perlindungan hukum PT. Jasa Raharja Cabang Banten terhadap korban kecelakaan tunggal dihubungkan dengan Undang- Undang Nomor 34 Tahun 1964 Tentang Dana Kecelakaan Lalu Lintas Jalan Juncto Peraturan Pemerintah Nomor 18 Tahun 1965 Tentang Ketentuan- Ketentuan Pelaksanaan Dana Kecelakaan Lalu Lintas Jalan? Teori yang digunakan yaitu Teori Kepastian Hukum dan Teori Perlindungan Hukum. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang- undangan dan pendekatan kasus, sumber datanya berupa data primer dan sekunder, teknik pengumpulan data berupa studi kepustakaan, wawancara dan observasi dan analisis data berupa analisis kualitatif. Hasil penelitian yaitu Proses klaim asuransi kecelakaan lalu lintas di PT Asuransi Jasa Raharja yaitu mengisi formulir pengajuan dengan melampirkan: Keterangan kecelakaan Lalu Lintas dari Kepolisian, Keterangan dari dokter,KTP / Identitas korban / ahli waris korban. Korban kecelakaan lalu lintas tunggal tidak menerima santunan karena sesuai dengan Undang-Undang Nomor 33 Tahun 1964 dan Undang- Undang Nomor 34 Tahun 1964 tidak berhak mendapatkan santunan. Kecelakaan tunggal yang dimaksud dengan korban laka lantas tunggal adalah sama sekali tidak ada kontak dengan kendaraan lain. Kemudian Perlindungan hukum bagi korban kecelakaan lalu lintas tunggal pada Asuransi PT Jasa Raharja untuk korban meninggal akibat kecelakaan tunggal maka pihak PT Jasa Raharja memberikan satunan. Yang mana besarnya santunan tergantung kebijakan dari pimpinan. Untuk kecelakaan tunggal dengan luka ringan dan patah pihak PT Jasa Raharja tidak bisa diklaim. | |||||||||
