Abstract

Mortgage Certificate is an authentic document intended as a marker that the land is in bank collateral, this serves so that banks get legal certainty and protection against claims, at any time if the debtor is unable to pay off the debt. But on the other hand, the existence of the mortgage certificate does not necessarily guarantee absolute repayment of creditor receivable financing. This is because if the mortgage certificate is sued through a lawsuit in court by a third party as the injured party, and the court in its decision cancels the mortgage certificate, the implications against the banking system is the existence of preferred creditor status on the certificate of mortgage rights turned into a concurrent creditor, and the receivables are at risk of not being able to return. With this, the identification of the problem is whether the cancellation of the mortgage certificate in the decision is in accordance with the applicable rules? What are the legal consequences of the cancellation of the certificate of mortgage rights on the object of mortgage rights that are partially controlled by a third party?. The author uses the theory of legal justice and the theory of legal certainty. The author also uses normative juridical method with research specification based on Legal Approach, Case Approach, and Concept Approach. The data used are secondary data and primary data, the results will be analyzed qualitatively. The results showed that the decision of the panel of judges in canceling the mortgage certificate as in the decision of PN Rangkasbitung No. 4/PDT.G/2020/PN.Rkb, according to the author, there is a mistake, because procedurally the encumbrance of mortgage rights has met the administrative procedures as stipulated in PP no. 24 of 1997 on Land Registration, Basic Agrarian Law, dan Mortgage Act. Implications of the ruling also creditors lose their status as preferred creditor, consequently creditor not getting legal protection against credit which he and potentially lost or not returned by the debtor. However, the decision was overturned by the decision of PT. Banten No.51 / PDT / 2021 / PT BTN and Cassation Decision No. 55 K/Pdt/2022, because the two decisions explicitly in the amar / dictum of the decision restore the creditor's status or position as a preferred creditor, so that the execution process of the object of collateral rights can be resumed. Additional Information: Sertifikat Hak Tanggungan merupakan dokumen otentik yang ditujukan sebagai penanda bahwa tanah sedang dalam agunan bank, ini berfungsi supaya perbankan mendapatkan kepastian dan perlindungan hukum terhadap piutangnya, sewaktu-waktu jika debitur tidak mampu melunasi hutangnya. Namun disisi lain sertifikat hak tanggungan tersebut keberadaannya tidak serta merta dapat menjamin pelunasan pembiayaan piutang kreditur secara mutlak. Sebab apabila sertifikat hak tanggungan tersebut digugat melalui suatu gugatan di pengadilan oleh pihak ketiga selaku pihak yang dirugikan, dan pengadilan dalam putusannya membatalkan sertifikat hak tanggungan, maka implikasinya terhadap perbankan adalah keberadaan status kreditur preferen atas sertifikat hak tanggungan beralih menjadi kreditur konkuren, dan piutangnya beresiko tidak dapat kembali. Dengan ini maka identifikasi masalahnya adalah : Apakah pembatalan sertifikat hak tanggungan (SHT) dalam putusan tersebut sudah sesuai dengan aturan berlaku? Bagaimana akibat hukum pembatalan sertifikat hak tanggungan (SHT) terhadap obyek hak tanggungan yang sebagiannya dikuasai oleh pihak ketiga?. Penulis menggunakan teori keadilan hukum dan teori kepastian hukum. Penulis juga menggunakan metode yuridis normatif dengan spesifikasi penelitian berdasarkan pendekatan perundang-undangan (Legal Approach), pendekatan kasus (Case Approach), dan pendekatan konsep (Concept Approach). Data yang digunakan yaitu data sekunder ditunjang data primer, hasilnya akan dianalisis secara kualitatif. Hasil penelitian menyatakan bahwa putusan majelis hakim dalam membatalkan sertifikat hak tanggungan sebagaimana dalam putusan PN. Rangkasbitung No. 4/PDT.G/2020/PN.Rkb, menurut penulis terdapat kekeliruan, sebab secara prosedural pembebanan hak tanggungan sudah memenuhi prosedur administrasi sebagaimana yang diatur didalam PP No. 24 Tahun 1997 tentang Pendaftaran Tanah, UU Pokok Agraria, dan UU Hak Tanggungan. Implikasi putusan tersebut juga membuat kreditur kehilangan statusnya sebagai kreditur preferen, akibatnya kreditur tidak mendapatkan perlindungan hukum terhadap kredit yang disalurkannya dan berpotensi hilang atau tidak dikembalikan oleh debitur. Namun putusan tersebut dibatalkan oleh Putusan PT. Banten No.51/PDT/2021/PT BTN dan Putusan Kasasi No. 55 K/Pdt/2022, sebab kedua putusan tersebut secara eksplisit dalam amar/diktum putusannya mengembalikan status atau kedudukan kreditur sebagai kreditur preferen, sehingga proses eksekusi terhadap obyek hak tanggungan dapat dilanjutkan kembali.
