Abstract

Same-sex marriage is one of the prohibited marriages in Indonesia and can be cancelled. One of the parties who can apply for an annulment of marriage is the Attorney. However, until now there has been no explicit mention in law number 16 of 2019 concerning marriage regarding parties who can apply to annul same-sex marriages. Therefore this study will discuss how the Prosecutor's Authority through the Civil and State Administrative fields in submitting requests for cancellation of same-sex marriages in terms of Law number 16 of 2019 concerning Marriage? religious court Number 540/Pdt.G/2020/PA.GM is in accordance with Law Number 16 of 2019 Concerning Marriage?, The theory used in this study is the theory of legal certainty and the research method used is normative juridical. The results of this study, that the Prosecutor as State Attorney through the Civil and State Administrative fields representing the State or the Government has the right to apply for the annulment of same-sex marriages as stated in article 26 of Law Number 16 of 2019 concerning Marriage, as well as articles 30 and article 32 Law Number 16 of 2004. The process of filing an application for cancellation of same-sex marriages by the West Nusa Tenggara High Prosecutors Office and the Mataram District Attorney through a Special Power of Attorney in case Number 540/Pdt.G/2020/PA.GM is in accordance with the provisions for registering cases in court. According to the Government Regulation of the Republic of Indonesia Number 9 of 1975 concerning the Implementation of Law Number 1 of 1974 concerning marriage that the procedure for submitting an application for annulment of marriage is carried out in accordance with the procedure for filing a divorce suit. The advice that can be given is for the Marriage Registrar to be more careful in the process of recording requests for marriage.

Additional Information:	Perkawinan sejenis menjadi salah satu perkawinan yang dilarang di Indonesia dan dapat dibatalkan. Pihak yang dapat mengajukan pembatalan perkawinan salah satunya adalah Jaksa. Namun hingga saat ini tidak disebutkan secara eksplisit dalam Undang-Undang Nomor 16 Tahun 2019 Tentang Perkawinan terkait pihak-pihak yang dapat mengajukan pembatalan perkawinan sesama jenis. Oleh karena itu penelitian ini akan membahas mengenai bagaimana kewenangan jaksa melalui bidang Perdata dan Tata Usaha Negara dalam pengajuan permohonan pembatalan perkawinan sejenis ditinjau dari undang-undang nomor 16 tahun 2019 tentang Perkawinan, dan apakah proses pengajuan pembatalan perkawinan sejenis yang dilakukan oleh jaksa pada putusan Pengadilan Agama Nomor 540/pdt.g/2020/PA.GM sudah sesuai dengan undang-undang nomor 16 tahun 2019 tentang perkawinan. Teori yang digunakan dalam penelitian ini adalah teori kepastian hukum. Adapun metode penelitian yang digunakan dalam penelitian ini adalah metode yuridis normatif. Adapun hasil dari penelitian ini adalah bahwa Jaksa sebagai Jaksa Pengacara Negara melalui bidang Perdata dan Tata Usaha Negara mewakili Negara atau Pemerintah berhak untuk mengajukan pembatalan perkawinan sejenis sebagaimana disebutkan dalam pasal 26 Undang-Undang Nomor 16 Tahun 2019 tentang Perkawinan, serta pasal 30 dan pasal 32 Undang-Undang Nomor 16 Tahun 2004 Tentang Kejaksaan. Terhadap proses pengajuan permohonan pembatalan perkawinan sejenis yang dilakukan Kejaksaan Tinggi Nusa Tenggara Barat dan Kejaksaan Negeri Mataram melalui Surat Kuasa Khusus pada perkara Nomor 540/Pdt.G/2020/PA.GM sudah sesuai dengan ketentuan pendaftaran perkara di pengadilan. Menurut Peraturan Pemerintah RI Nomor 9 Tahun 1975 Tentang Pelaksanaan Undang-Undang Nomor 1 Tahun 1974 Tentang Perkawinan bahwa tata cara pengajuan permohonan pembatalan perkawinan dilakukan sesuai dengan tata cara pengajuan gugatan cerai. Adapun saran yang dapat diberikan adalah agar pihak Pegawai Pencatat Perkawinan lebih teliti lagi dalam proses pencatatan permohonan kehendak kawin.
