Abstract

In Article 7 paragraph (1) Serang City Regional Regulation No. 4 of 2009 concerning retribution for trading business licenses (SIUP). the government must provide the main provisions, namely legality so that people who run their businesses comply with existing regulations. As for the identification of the problem, namely how is the Government's authority regarding the implementation of business licenses, does it make it easier or an obstacle for the community in making business licenses? In this study, the theory used by the author is the Authority Theory and the Licensing Theory. The research method used is empirical juridical. research specification used by the author is descriptive analysis. The data source is primary data supported by secondary data. Data collection techniques are interviews with parties related to research. The data were obtained and analyzed descriptively by the authors using a qualitative approach. The results of this study regarding the government's authority in issuing letters of establishing trade business licenses in the city of Serang. The conclusion is that based on statutory regulations, the government, in this case the DPMPTSP, has carried out its duties in serving the needs of the community. The suggestion is that the government must be more massive in socializing so that the transition program from offline to online is maximized and the community also feels the benefits and impact of government programs.

Additional Information:	Pada Pasal 7 ayat (1) Peraturan Daerah Kota Serang Nomor 4 Tahun 2009 tentang retribusi surat izin usaha perdagangan (SIUP). pemerintah harus memberikan bekal utama yaitu legalitas agar masyarakat yang menjalankan usaha nya sesuai dengar peraturan yang ada. Adapun identifikasi masalahnya yaitu Bagaimana Kewenangan Pemerintah tentang pelaksanaan izin usaha apakah membuat kemudahan atau halangan bagi masyarakat dalam membuat izin usaha?, Kemudian Untuk mendeskripsikan apakah dampak terhadap masyarakat yang mau melakukan perizinan usaha. Dalam penelitian iniTeori yang digunakan oleh penulis ialah Teori Kewenangan dan Teori Perizinan. Metode Penelitian yang digunakan yaitu yuridis empiris. spesifikasi penelitian yang digunakan oleh penulis bersifat deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara kepada pihak yang terkait dengan penelitian. Data diperoleh dan dianalisis secara deskriptif oleh penulis dengan metode pendekatan Kualitatif. Hasil Penelitian ini mengenai kewenangan pemerintah dalam memberikan surat mendirikan izin usaha perdagangan di kota Serang, Bahwa upaya pemerintah kota serang dalam melayani masyarakat dengan maksimal dalam membuat surat izin usaha pedagangan tergolong belum efektif. Kesimpulannya ialah berdasarkan peraturan perundang-undangan maka pemerintah dalam hal ini DPMPTSP telah melaksanakan tugasnya dalam melayani kebutuhan masyarakat. Sarannya adalah pemerintah harus lebih masif dalam bersosialisasi supaya program transisi dari offline menjadi daring lebih maksimal dan masyarakat juga merasakan manfaat dan dampak dari program pemerintah.
