Abstract

The inspiration for writing this thesis came from anxiety over the polemic on freedom of expression in the last decade. Caught in various research forms of silencing ranging from criminalization until digital attacks on people who actively make corrections to government work. This created fear for 62.9% of the public in expressing their opinion, so that Indonesia in 2022 would be in the group of countries flawed democracy based on the released democracy index report The Economist Intelligence Unit (EIU). This issue is further investigated using a qualitative phenomenological approach which can explore the experiences and meanings of informants regarding the implementation of freedom of expression in the digital era in the Joko Widodo regime. Then the data is reviewed using Beetham's concept of democracy and concepts cyberspace of democracy Wilhelm. The results of the study show a portrait of the implementation of freedom of expression in the digital era in the Joko Widodo regime based on the experience of the people that they are in a state of shrinking civil liberties and the vulnerability of democracy to the existence of cyber torture, judicial harassment, virtual police (law enforcement illicit affiliations with public officials). The community expresses a lack of control in the governance process because they feel threatened by the existing situation. So they reject the silencing of opinion and want the state's responsibility in upholding, supporting, and protecting the right to freedom of expression.

Additional Information:	Inspirasi penulisan skripsi ini datang dari keresahan terhadap polemik kebebasan berpendapat dalam satu dekade terakhir. Tertangkap diberbagai penelitian bentuk pembungkaman mulai dari kriminalisasi hingga serangan digital kepada masyarakat yang aktif melakukan koreksi terhadap kerja pemerintah. Hal tersebut menimbulkan ketakutan bagi 62,9% masyarakat dalam menyampaikan pendapat, sehingga Indonesia di tahun 2022 berada dalam kelompok negara flawed democracy berdasarkan laporan indeks demokrasi yang dirilis The Economist Intelligence Unit (EIU). Persoalan tersebut diteliti lebih lanjut dengan menggunakan metode kualitatif pendekatan fenomenologi yang dapat mengeksplorasi pengalaman dan pemaknaan informan terkait pelaksanaan kebebasan berpendapat di era digital pada rezim Joko Widodo. Kemudian data tersebut dikaji menggunakan konsep demokrasi Beetham dan konsep cyberspace of democracy Wilhelm. Hasil penelitian memperlihatkan potret pelaksanaan kebebasan berpendapat di era digital pada rezim Joko Widodo berdasarkan pengalaman masyarakat bahwa berada dalam kondisi penyusutan kebebasan sipil dan kerentanan demokrasi dengan adanya cyber torture, judicial harassment, virtual police (afiliasi gelap penegak hukum dengan pejabat publik). Masyarakat mengungkapkan minimnya kendali dalam proses penyelenggaraan pemerintahan karena merasa terancam dengan situasi yang ada. Sehingga mereka menolak pembungkaman pendapat dan menginginkan tanggung jawab negara dalam menegakkan, mendukung, dan melindungi hak kebebasan berpendapat.
