Abstract

Pemegang dasar penguasaan atas tanah adalah pihak yang memiliki bukti diterbitkan oleh pejabat berwenang, misalnya pemegang Akta Jual Beli atas hak atas tanah belum di balik nama, pemegang Akta Jual Beli atas hak milik adat yang belum diterbitkan Sertifikat, dan pemegang surat izin menghuni. Identifikasi masalah yang dibahas bagaimana menentukan kebasahan secara hukum antara bukti Sertifikat Hak Milik (SHM) dan Akta Jual Beli (AJB) atas bidang tanah berdasarkan Undang- Undang yang berlaku kemudian bagaimana Putusan Hakim memberikan pertimbangan hukum dalam menentukan pemegang Sertifikat hak atas tanah yang berhak menerima pembayaran ganti rugi pembebasan bidang tanah dalam putusan Nomor 311/Pdt.G/2020/PN.Tng. Teori yang digunakan penulis dalam penelitian ini adalah teori kepastian hukum dan Teori perlindungan hukum. Metode penelitian yaitu Yuridis Normatif. Spesifikasi penelitian yaitu Deskriptif Analitis. Sumber data yaitu penelitian Normatif data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Teknik pengumpulan data dilakukan melalui penelitian kepustakaan (Library Research). Analisis data dengan teknik Deskriptif Kualitatif. Hasil penelitian dari keabsahan bukti hak atas tanah baik Sertifikat Hak Milik (SHM) maupun Akta Jual Beli (AJB) yakni akta otentik yang sama-sama bisa di buktikan secara fisik dan data yuridisnya. Pemegang dasar Sertifikat Hak Milik (SHM) merupakan bukti yang kuat secara formil selama tidak dibuktikan sebaliknya baik Sertifikat Hak Milik (SHM) dan Akta Jual Beli (AJB) sama sama akta otentik yang mana keduanya dapat dibuktikan secara data fisik dan data. Saran yang direkomendasikan oleh penulis adalah perlu adanya pengaturan hukum pertanahan mengenai hak milik atas tanah dengan hal-hal materil lebih mendalam.

The research method is Normative Juridical. The research specification is Analytical Descriptive. The data source is Normative research of secondary data consisting of primary, secondary, and tertiary legal materials. Data collection techniques are carried out through library research. Data analysis with Qualitative Descriptive techniques. The results of research from the validity of evidence of land rights, both Certificate of Property Rights (SHM) and Deed of Sale and Purchase (AJB), namely authentic deed that can both be proven physically and juridical data. The basic holder of the Certificate of Property Rights (SHM) is formally strong evidence as long as it is not proven otherwise, both the Certificate of Property Rights (SHM) and the Deed of Sale and Purchase (AJB) are the same as authentic deed where both of which can be proven in physical data and data. The advice recommended by the author is that there is a need for land law arrangements regarding land ownership rights with more in-depth material matters.
