Abstract
Persons with disabilities have the right to get public facilities, one of which is a special parking lot. People with disabilities still get unfair treatment because there are still many parking spots that do not provide parking for people with disabilities. With this condition, it can be stated that the special parking places for disability in Serang City are not friendly enough for people with disabilities. Identification of the problem, What is the authority of the Department of Transportation in the availability of special parking facilities in Serang City?, Then what are the obstacles in the implementation of special parking facilities for persons with disabilities by the Serang City Transportation Service? The theories used are the theory of authority and the theory of public policy. The method of writing is juridical empirical. The research specification is descriptive analysis. The data used in this study is data obtained from secondary data in the form of primary legal materials, namely legislation and primary data in the form of interviews at the Serang City Transportation Office with the supporting sociological juridical data and analyzed descriptively qualitatively. The results of the research on the authority of the Department of Transportation in the availability of facilities for special parking spaces for persons with disabilities, that the Serang City government gave authority to the Serang City Transportation Service for the availability of special parking spaces for persons with disabilities. namely by conducting socialization to provide direction to parking operators to provide special parking spaces as stated in Article 12 paragraph (1) of the Serang Mayor Regulation which contains Parking Place Operators must provide Parking facilities for, Persons with Disabilities, Elderly People, Pregnant Women and Bicycle. The conclusion is that based on the procedures for organizing parking spaces, the Serang City Transportation Service has not fully exercised its authority because it has not done much socialization to parking operators so that these regulations are not widely known by parking operators. The suggestion is that the Department of Transportation can disseminate information to all parking operators so that public facilities for persons with disabilities can be provided in accordance with applicable standards.

| Additional Information: | Penyandang Disabilitas memiliki hak untuk mendapatkan Fasilitas umum salah satunya adalah tempat parkir khusus, Penyandang disabilitas masih mendapatkan perlakuan yang tidak adil karena masih banyaknya titik tempat perparkiran yang belum menyediakan perparkiran untuk penyandang disabilitas. Dengan kondisi ini bisa disebutkan bahwa tempat parkir khusus disabilitas di Kota serang belum cukup ramah untuk penyandang disabilitas. Identifikasi Masalahnya, Bagaimana kewenangan Dinas Perhubungan dalam ketersediaan sarana prasarana tempat parkir khusus di Kota Serang?, Kemudian Apa kendala dalam penyelenggaraan sarana prasarana tempar parkir khusus penyandang disabilitas oleh Dinas Perhubungan Kota Serang?, Teori yang digunakan yaitu teori kewenangan dan teori kebijakan publik. Metode penulisan yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Data yang digunakan dalam penelitian ini adalah data yang diperoleh dari data sekunder berupa bahan hukum primer yaitu peraturan perundang-undangan dan data primer berupa wawancara di kantor Dinas Perhubungan Kota Serang dengan bagian penunjang data yuridis sosiologis dan dianalisis secara deskriptif kualitatif. Hasil Penelitian mengenai Kewenangan Dinas Perhubungan dalam ketersediaan sarana prasarana tempat parkir khusus penyandang disabilitas bahwa pemerintah Kota Serang memberikan kewenangan kepada Dinas Perhubungan Kota Serang terhadap ketersediaan tempat parkir khusus penyandang disabilitas, Upaya yang dilakukam oleh Dinas Perhubungan Kota Serang dalam ketersediaan sarana prasarana tempat parkir khusus disabilitas yaitu dengan melakukan sosialisasi untuk memberikan arahan terhadap penyelenggara perparkiran untuk menyediakan tempat parkir khusus tersebut sebagaimana telah tercantum pada pasal 12 ayat (1) Peraturan Walikota Serang yang berisi Penyelenggara Tempat Parkir wajib menyediakan fasilitas Parkir untuk, Penyandang Disabilitas , Orang Lanjut Usia, Ibu Hamil dan Sepeda. Kesimpulannya bahwa berdasarkan prosedur dalam menyelenggarakan tempat perparkiran, Dinas Pergubungan Kota Serang belum sepenuhnya melaksanakan kewenagannya karena belum banyak melakukan sosialisasi kepada para penyelenggara parkir sehingga peraturan tersebut belum banyak diketahui oleh para penyelenggara perparkiran. Saranya adalah Dinas Perhubungan dapat melakukan sosialisasi kepada seluruh penyelenggara perparkiran agar dapat disediakanya fasilitas publik untuk penyandang disabilitas sesuai standar yang ada. | |||||||||
