Abstract

ABSTRACT Police law enforcement officers have the authority to act on traffic violations regulated in Law Number 22 of 2009 concerning Road Traffic and Transportation because there are still many people in Cilegon City who lack awareness in traffic. law enforcement efforts against traffic violations in Cilegon City based on Law Number 22 of 2009 concerning Road Traffic and Transportation? then what are the efforts made by the Cilegon Resort Police in increasing traffic law awareness in Cilegon City? The theory used is the theory of authority and law enforcement theory. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. Data collection techniques are interviews and documents related to research. The data were obtained and analyzed descriptively using a qualitative approach. The results of research on the authority of the Cilegon Resort Police are regulated in Article 7 paragraph (2) letter e of Law Number 22 of 2009 concerning Road Traffic and Transportation while law enforcement efforts against traffic violations are regulated in Article 265 namely preemptively making efforts in the form of socialization, by preventive measures, guarding, guarding and patrolling, repressively carrying out fines with a total of 960 violators and 1958 warnings. The conclusion is that based on the authority given by the Cilegon Resort Police, they have carried out their authority through attribution, delegation and mandate and based on Article 265 law enforcement is a preemptive effort in the form of outreach to schools and to the community, preventively with arrangements, guarding, escorts and patrols and repressive efforts with reprimands and fines. The suggestion is that the Cilegon Resort Police make more preventive efforts to increase education to the public to increase understanding of the Traffic Law and repressively carry out more intensive reprimands and enforce fines strictly in an effort to enforce traffic laws. Additional Information:	ABSTRAK Aparat penegak hukum polisi memiliki wewenang untuk menindak pelanggaran lalu lintas yang diatur didalam Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan karena masih banyaknya masyarakat Kota Cilegon akan kurangnya kesadaran dalam berlalu lintas, Adapun identifikasi masalahnya yaitu bagaimana kewenangan Kepolisian Resort Cilegon dalam upaya penegakan hukum terhadap pelanggaran lalu lintas di Kota Cilegon berdasarkan Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan? kemudian bagaimana upaya yang di lakukan oleh Kepolisian Resort Cilegon dalam meningkatkan kesadaran hukum lalu lintas di Kota Cilegon? Teori yang digunakan yaitu teori kewenangan dan teori penegakan hukum. Metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian. Data diperoleh dan dianalisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian kewenangan Kepolisian Resort Cilegon diatur dalam Pasal 7 ayat (2) huruf e Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan sedangkan upaya penegakan hukum terhadap pelanggaran lalu lintas diatur dalam Pasal 265 yaitu secara preemtif melakukan upaya berupa sosialisasi, secara preventif dengan pengaturan, penjagaan, pengawalan dan patroli, secara represif melakukan penindakan penilangan dengan jumlah pelanggar 960 serta teguran 1958. Kesimpulannya adalah berdasarkan kewenangan yang diberikan Kepolisian Resort Cilegon telah melakukan kewenangannya melalui atribusi, delegasi dan mandat dan berdasarkan Pasal 265 penegakan hukum secara upaya preemtif dalam bentuk sosialisasi ke sekolah dan ke masyarakat, secara preventif dengan pengaturan, penjagaan, pengawalan dan patroli dan upaya represif dengan teguran dan penilangan. Sarannya adalah agar Kepolisian Resort Cilegon lebih mengupayakan secara preventif untuk meningkatkan edukasi kepada masyarakat untuk meningkatkan pemahaman tentang Undang-Undang Lalu Lintas dan secara represif lebih intensif melakukan teguran dan penindakan tilang secara tegas dalam upaya penegakan hukum lalu lintas.
