Abstract
As a form of effort to tackle TIP crimes, cooperation between law enforcers and related institutions is needed. However, the facts show that crime prevention, in this case the Crime of Trafficking in Persons, has not been fully implemented. One of the cases that occurred based on Decision No. 49/Pid. Sus/2018/PN. Smg, namely the judge decided that the defendant was free from all lawsuits (onstlag van rechtvervolging) against the defendant with the judge's consideration that the defendant was proven but not a criminal act. However, the defendant was proven to have committed the crime of trafficking in persons so that the defendant should have been sentenced using Article 4 jo. Article 48 of Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons. So that the authors identify the problem, namely: First, what is the basis for the judge's considerations in passing a decision to release all lawsuits against directors who place Indonesian workers abroad? Second, what are the criminal provisions against perpetrators of trafficking in Indonesian Migrant Workers abroad? The theory used in this study is the theory of judge judgment and the theory of criminal responsibility. This research method uses normative juridical research methods. The approach to the problem is the statutory approach. The data sources used are secondary data sources through books, journals and articles related to this research. The results of the research show that the judge should not only consider the second indictment but also have to choose and consider the first indictment so that the judge should make a decision that the defendant has been legally proven guilty of violating Article 4 in conjunction with Article 48 of Law Number 21 of 2007 concerning Eradication of Trafficking Crimes Person. The conclusions are: First, judges do not provide legal certainty and justice to victims and lead to reduced public trust in law enforcers. Second, the criminal provisions against traffickers of TKI are very different from the reality that occurs according to the results of decision No. 49/Pid. Sus/2018/PN. smh Suggestions are: First, the judge considers each indictment prepared by the public prosecutor so that there is no bad opinion from the public towards law enforcement officials. Second, the implementation of Law no. 21 of 2007 is increasingly strengthened and used by law enforcers in handling cases of criminal acts of trafficking in persons. Additional Information: | Sebagai bentuk upaya menanggulangi kejahatan TPPO, dibutuhkan kerja sama antara penegak hukum dan lembaga yang terkait. Namun, fakta menunjukkan bahwa penanggulangan kejahatan dalam hal ini Tindak Pidana Perdagangan Orang belum sepenuhnya dilakukan. Salah satu kasus yang terjadi berdasarkan Putusan No. 49/Pid.Sus/2018/PN. Smg yaitu Hakim memutuskan putusan lepas dari segala tuntutan hukum (onstlag van rechtvervolging) terhadap terdakwa dengan pertimbangan Hakim bahwa terdakwa terbukti namun bukan perbuatan pidana. Akan tetapi, terdakwa terbukti telah melakukan tindak pidana perdagangan orang sehingga seharusnya terdakwa dipidana menggunakan Pasal 4 jo. Pasal 48 Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Sehingga penulis mengidentifikasi masalah yaitu: Pertama, bagaimana dasar pertimbangan hakim dalam menjatuhkan putusan lepas dari segala tuntutan hukum terhadap direktur yang melakukan penempatan Tenaga Kerja Indonesia di luar negeri? Kedua, bagaimana ketentuan pidana terhadap pelaku perdagangan Tenaga Kerja Indonesia di luar negeri?. Teori yang digunakan dalam penelitian ini yaitu teori pertimbangan hakim dan teori pertanggungjawaban pidana. Metode penelitian ini menggunakan metode penelitian yuridis normatif. Pendekatan masalah tersebut adalah pendekatan perundang-undangan. Sumber data yang digunakan adalah sumber data sekunder melalui buku, jurnal dan artikel yang berhubungan dengan penelitian ini. Hasil penelitian menunjukkan seharusnya Hakim tidak hanya mempertimbangkan dakwaan kedua saja tetapi juga harus memilih dan mempertimbangkan dakwaan kesatu sehingga Hakim seharusnya menjatuhkan putusan bahwa terdakwa telah terbukti secara sah bersalah telah melanggar Pasal 4 jo Pasal 48 Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Kesimpulan yaitu: Pertama, hakim tidak memberikan kepastian dan keadilan hukum pada korban dan menimbulkan berkurangnya kepercayaan masyarakat kepada para penegak hukum. Kedua, ketentuan pidana terhadap pelaku perdagangan TKI sangat berbeda dengan kenyataan yang terjadi sesuai dari hasil putusan No. 49/Pid.Sus/2018/PN. Smg. Saran yaitu: Pertama, hakim mempertimbangkan setiap dakwaan yang disusun oleh JPU agar tidak terdapat pandangan buruk dari masyarakat terhadap apparat penegak hukum. Kedua, implementasi terhadap Undang-Undang No. 21 Tahun 2007 semakin diperkuat dan digunakan oleh para penegak hukum dalam menangangi kasus tindak pidana perdagangan orang.
