Abstract

One of the problems disturbing public order in Cilegon City is the presence of silver people in Cilegon City. Thus, the Cilegon City Satpol PP Service has the authority to administer public order and peace, and organize community protection in each region. Identification of the problem in this study, namely how is the authority of the Cilegon City Civil Service Police Unit in controlling silver people in Cilegon City? as well as what are the inhibiting factors and efforts to find solutions for the Cilegon City Civil Service Police Unit in controlling silver people in Cilegon City?. The theory used is the theory of authority and law enforcement theory. This study uses a research method, namely the empirical juridical method. The specification of the research used is descriptive analytical research. This study uses primary data sources and secondary data. Data collection techniques in this study are using field research techniques, library research. Data analysis in this research uses a qualitative descriptive approach. The results of the research are silver people in Cilegon City violating Cilegon City Regional Regulation No. 5 of 2003 concerning Order, Cleanliness and Beauty (K3) in the Cilegon City Region. The conclusion is based on research, namely based on Article 7 of Government Regulation Number 16 of 2018 concerning Civil Service Police Units, the Cilegon City Satpol PP Service in exercising its controlling authority over silver people in Cilegon City is to take non-judicial measures, not to act against silver people in Cilegon City, to carry out patrolling, conducting coaching if it doesn't create a deterrent effect then rehabilitation will be carried out. The inhibiting factors are laws and regulations that do not yet cover regulations regarding order in more detail, law enforcement is not maximal yet, facilities or facilities, namely the absence of official data related to silver people in Cilegon City, lack of budget and limited vehicles, factor of lack of public education, the cultural factor of the existence of silver people in Cilegon City, as well as the existence of solutions that have been made. The recommended suggestions are to pay more attention to aspects of the provisions stipulated in Article 7 Government Regulation Number 16 of 2018 concerning Civil Service Police Units, official development of silver people in Cilegon City, Cilegon City regional regulations regarding silver people are ratified, service management is implemented better, there is official data related to silver people in Cilegon City, there is more two way communication between the community and the government.

Additional Information:	Salah satu permasalahan yang mengganggu ketertiban umum di Kota Cilegon ialah adanya manusia silver di Kota Cilegon. Maka, Dinas Satpol PP Kota Cilegon mempunyai kewenangan dalam menyelenggarakan ketertiban umum dan ketenteraman, dan menyelenggarakan perlindungan masyarakat di setiap daerah. Identifikasi masalah dalam penelitian ini yaitu bagaimana kewenangan Dinas Satuan Polisi Pamong Praja Kota Cilegon dalam penertiban terhadap manusia silver di Kota Cilegon? serta bagaimana faktor penghambat dan upaya solusi Dinas Satuan Polisi Pamong Praja Kota Cilegon dalam penertiban terhadap manusia silver di Kota Cilegon?. Teori yang digunakan ialah teori kewenangan dan teori penegakan hukum. Penelitian ini menggunakan metode penelitian yaitu metode yuridis empiris. Spesifikasi penelitian yang digunakan adalah penelitian deskriptif analitis. Penelitian ini menggunakan sumber data primer dan data sekunder. Teknik pengumpulan data dalam penelitian ini yaitu menggunakan teknik penelitian lapangan, penelitian kepustakaan. Analisis data dalam penilitian ini menggunakan pendekatan deskriptif kualitatif. Hasil penelitian yaitu manusia silver di Kota Cilegon melanggar Peraturan Daerah Kota Cilegon Nomor 5 Tahun 2003 tentang Ketertiban, Kebersihan dan Keindahan (K3) di Wilayah Kota Cilegon. Kesimpulan berdasarkan penelitian yaitu berdasarkan Pasal 7 Peraturan Pemerintah Nomor 16 Tahun 2018 tentang Satuan Polisi Pamong Praja, maka Dinas Satpol PP Kota Cilegon dalam melaksanakan kewenangan penertiban terhadap manusia silver di Kota Cilegon ialah melakukan tindakan penertiban nonyustisial, tidak menindak manusia silver di Kota Cilegon, melaksanakan patroli, melakukan pembinaan jika tidak membuat efek jera maka akan dilakukan rehabilitasi. Faktor penghambatnya yaitu peraturan perundang-undangan yang belum mencakup peraturan tentang ketertiban secara lebih rinci, belum maksimalnya penegak hukum, faktor sarana atau fasilitas yaitu belum adanya data resmi terkait manusia silver di Kota Cilegon, kurangnya anggaran dan kendaraan yang terbatas, faktor kurangnya edukasi terhadap masyarakat, faktor kebudayaan adanya manusia silver di Kota Cilegon, serta adanya upaya solusi yang dilakukan. Saran yang direkomendasikan yaitu lebih memperhatikan aspek ketentuan yang diatur pada Pasal 7 Peraturan Pemerintah Nomor 16 Tahun 2018 tentang Satuan Polisi Pamong Praja, pembinaan manusia silver di Kota Cilegon secara resmi, peraturan daerah Kota Cilegon tentang manusia silver di sahkan, manajemen dinas terlaksana dengan lebih baik, adanya data resmi terkait manusia silver di Kota Cilegon, lebih adanya komunikasi dua arah antara masyarakat dengan pemerintah.
