Abstract
The problem of the Pancasila Ideology Direction Draft Law is because it does not include TAP MPRS Number XXV / MPRS / 1966 concerning the dissolution of the Indonesian Communist Party, a statement as a prohibited organization throughout the territory of the Republic of Indonesia and a ban on any activity to spread or develop the ideology or teachings of communism / marxism-leninsm. The identification of problems in this study, How is the position of the Pancasila Ideology Direction Draft Law from the perspective of Indonesian state ideology? and How is relevancy of the Pancasila Ideology Direction Draft Law into law in terms of Law Number 12 of 2011 concerning the Establishment of Legislation. The theory used is the theory of Pancasila legal state and the theory of Pancasila democracy. The research method used is normative juridical with secondary data sources consisting of primary legal materials, namely laws, journal books, secondary legal materials and tertiary legal materials. Data collection techniques are carried out by literature study and research analysis used by researchers is qualitative analysis by describing the subject and object of research. The results show that the proposed Pancasila Ideology Direction Bill still has shortcomings in making each article of the Pancasila Ideology Direction Bill. The non-inclusion of TAP MPRS Number XXV / MPRS 1966 is a major factor in this result, because it will bring up or revive the Indonesian Communist Party. The conclusion based on this research is that Pancasila as the life of the nation and state is the highest norm and state philosophy, so that, with the passing of the Pancasila Ideology Direction Bill, it can reduce the position and demean the position of Pancasila itself. Suggestions based on this research, Pancasila as Philohische Groundslag as the basic philosophy of the Indonesian nation is the basis in the Indonesian state constitution. So, it is recommended that the House of Representatives not continue the discussion of the Draft Law on the Ideology of Pancasila, because it can change the position of the state constitution and the life of the nation and state of the Indonesian people. Adapun identifikasi masalah dalam penelitian ini, Bagaimana kedudukan Rancangan Undang-Undang Haluan Ideologi Pancasila dari perspektif ideologi negara Indonesia? dan Bagaimana relevansi Rancangan Undang-Undang Haluan Ideologi Pancasila menjadi undang-undang ditinjau dari undang-undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan?. Teori yang digunakan yaitu teori negara hukum pancasila dan teori demokrasi pancasila. Metode penelitian yang digunakan yaitu yuridis normatif dengan sumber data sekunder yang terdiri dari bahan hukum primer, yaitu Undang-Undang, buku jurnal, bahan hukum sekunder dan bahan hukum tersier. Teknik pengumpulan data dilakukan dengan studi kepustakaan serta analisis penelitian yang dipakai peneliti ialah analisis kualitatif dengan memaparkan subjek serta objek penelitian. Hasil menunjukan bahwa pengusulan Rancangan Undang-Undang Haluan Ideologi Pancasila bahwa masih memiliki kekurangan dalam pembuatan setiap pasal Rancangan Undang- Undang Haluan Ideologi Pancasila. Tidak dicantukannya TAP MPRS Nomor XXV/MPRS 1966 merupakan faktor utama dalam hasil ini, karena akan memunculkan atau membangkitkan Kembali Partai Komunis Indonesia. Kesimpulan berdasarkan penelitian ini, pancasila sebagai kehidupan berbangsa dan bernegara merupakan norma paling tinggi dan falsafah negara, sehingga, dengan disahkannya Rancangan Undang-Undang Haluan Ideologi Pancasila, dapat menurunkan kedudukan dan merendahkan posisi pancasila itu sendiri. Saran berdasarkan penelitian ini, pancasila sebagai Philohische Groundslag sebagai filosofi dasar bangsa Indonesia merupakan dasar dalam konstitusi negara Indonesia. Maka, disarankan agar Dewan Perwakilan Rakyat tidak melanjutkan pembahasan Rancangan Undang- Undang Haluan Ideologi Pancasila, karena dapat merubah kedudukan konstitusi negara serta kehidupan berbangsa dan bernegara masyarakat Indonesia.
