Abstract

ABSTRAK “TINJAUAN YURIDIS PENOLAKAN PROTOKOL COVID-19 DI RUMAH SAKIT OLEH KELUARGA PASIEN BERDASARKAN UNDANG-UNDANG NOMOR 4 TAHUN 1984 TENTANG WABAH PENYAKIT MENULAR” Pemerintah Indonesia dalam rangka memutus mata rantai penyebaran virus Covid-19 menerbitkan Peraturan Pemerintah Nomor 21 tahun 2020 tentang Pembatasan Sosial Berskala Besar Dalam Rangka Penanganan Virus Covid-19. Penyebaran virus Covid-19 di Indonesia saat ini sangat meningkat dan diiringi dengan kasus kematian pada pasien yang disebabkan karena terjangkit virus Covid-19. Pemerintah dan masyarakat berperan penting dalam menangani dan pencegahan virus Covid-19 dengan menggunakan metode menggunakan masker, menjaga jarak dan mencuci tangan dengan sabun. Penelitian ini menelusuri tentang tinjauan yuridis penolakan protokol Covid-19 di rumah sakit oleh keluarga pasien berdasarkan Undang-Undang Nomor 4 Tahun 1984 tentang wabah penyakit menular. Banyaknya kasus terkait penolakan protokol kesehatan di masyarakat terjadi karena rendahnya kepatuhan dan kesadaran keluarga pasien dalam menerapkan protokol kesehatan saat berada di rumah sakit sangat renadah dimana akan sangat berisiko pada diri sendiri, pasien, tenaga kesehatan dan lingkungan sekitar dalam penularan Covid-19. Penolakan keluarga pasien di lapangan terkait protokol kesehatan yang dilakukan keluarga pasien karena tidak percaya dengan rumah sakit untuk tetap memakamkan jenzah pasien Covid-19 tanpa protokol kesehatan. Banyaknya kasus penolakan oleh keluarga pasien terhadap pemakaman jenazah Covid-19 menjadi perhatian yang serius. Penelitian ini adalah penelitian yuridis normatif yang meneliti Undang-Undang Nomor 4 Tahun 1984 tentang wabah penyakit menular dan keseluruhan sistem hukum di Indonesia yang masih kurang lengkap sehingga masih kurang memberikan jaminan hukum yang bertujuan untuk mengetahui perlindungan hukum terhadap rumah sakit dalam melaksanakan protokol Covid-19. Data diperoleh dengan melalui studi kepustakaan (Library Research) dan pengambilan data ke rumah sakit. Hasil penelitian menunjukkan dalam penanganan dan pencegahan penyebaran Covid-19 diatur dalam peraturan perundang-undangan dari tingkat pusat dan tingkat daerah sebagaimana yang telah di terbitkan Peraturan Daerah Provinsi Banten Nomor 1 Tahun 2021 Tentang Penanggulangan Corona Virus Disease untuk mengantisipasi dan peningkatan kasus Covid-19 di daerah banten. The spread of the Covid-19 virus in Indonesia is currently greatly increasing and accompanied by cases of death in patients caused by contracting the Covid-19 virus. The government and the public play an important role in handling and preventing the Covid-19 virus by using a method of using masks, maintaining distance and washing hands with soap. The study traces the juridical review of the rejection of the Covid-19 protocol in hospitals by patients' families under law No. 4 of 1984 on infectious disease outbreaks. The number of cases related to the rejection of health protocols in the community occurs due to low compliance and awareness of the patient's family in implementing health protocols while in the hospital. It is very vulnerable where it will be very risky to yourself, patients, health workers and the surrounding environment in the transmission of Covid-19. Refusal of the patient's family in the field related to health protocols carried out by the patient's family because they do not trust the hospital to keep burying the patient's body. Covid-19 without health protocols. The number of cases of rejection by the patient's family of funeral Covid-19 is of serious concern. This research is a normative juridical study that examines Law No. 4 of 1984 on infectious disease outbreaks and the entire legal system in Indonesia which is still incomplete so that it still lacks legal guarantees aimed at knowing the legal protection of hospitals in implementing the Covid-19 protocol. The data is obtained through library research and data retrieval to the hospital. The results showed that the handling and prevention of the spread of Covid-19 is regulated in the laws and regulations of the central and regional levels as published by Banten provincial regulation number 1 of 2021 on the prevention of corona virus disease to anticipate and increase cases of Covid-19 in Banten area.
