Abstract
This research discusses the protection of the copyrights of films that are played back on television without any royalty payments, such as the film Warkop DKI. Identification of the problems in this research are: (1) How is the copyright protection for films that are played back on television without any royalty payments based on Law Number 28 of 2014 concerning Copyright on the Warkop DKI film? (2) How is the settlement of disputes regarding the screening of the film Warkop DKI on television which does not pay royalties to the recipients of royalties on the film? Work is the result of the work of the creator in a unique form and shows its authenticity in the fields of science, art and literature. The method used in this research is a case study qualitative research approach. The law being reviewed is Law Number 28 of 2014 Concerning Copyright. The location studied was the Regional Office of the Banten Ministry of Law and Human Rights and conducted interviews with Indro Warkop DKI. Data collection techniques in this study were in the form of observation, interviews and documentation. The conclusion of this research shows that Law No. 28 of 2014 Concerning Copyrights is good enough. However, for copyright protection the Warkop DKI film has not been fully protected by Law No. 28 of 2014 concerning Copyright because the moral and economic rights have not been fulfilled from repeated broadcasts by several television stations to Warkop DKI. For example, out of 34 Warkop DKI films, only 4 films earned royalties because they were purchased by Falcon Pictures and there is no regulation regarding the company's royalty obligation to film actors, making it difficult for film players to obtain royalties from the films played and the absence of a Collective Management Institution for film actors making demands. for Royalties to Film Producers. Suggestions from this research are the need for special regulations regarding the obligation to distribute royalties for film works played by the parties involved and make a mutually binding written agreement about what rights are obtained and the obligations that must be carried out for the film's copyrighted works and the need to establish an Institution Collective Management. Identifikasi masalah dalam penelitian ini adalah: (1) Bagaimana perlindungan hak cipta terhadap karya film yang diputar ulang di televisi tanpa adanya pembayaran royalti berdasarkan Undang-Undang Nomor 28 tahun 2014 tentang Hak Cipta pada film Warkop DKI? (2) Bagaimana penyelesaian sengketa terhadap kasus pemutaran film Warkop DKI di televisi yang tidak memberikan royalti pada penerima royalti pada film tersebut? Ciptaan adalah hasil karya pencipta dalam bentuk yang khas dan menunjukkan keasliannya dalam lapangan ilmu pengetahuan, seni, dan sastra. Metode yang digunakan pada penelitian ini adalah pendekatan penelitian kualitatif studi kasus. Adapun undang-undang yang menjadi tinajauan adalah UU Nomor 28 Tahun 2014 Tentang Hak Cipta. Lokasi yang diteliti adalah Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Banten dan melakukan wawancara pada Indro Warkop DKI. Teknik pengumpulan data pada penelitian ini berupa observasi, wawancara, dan dokumentasi. Kesimpulan penelitian ini menunjukkan, bahwasanya Undang-undang No 28 tahun 2014 Tentang Hak Cipta, sudah cukup baik. Akan tetapi untuk perlindungan hak cipta pada film Warkop DKI belum sepenuhnya dilindungi oleh Undang-undang No 28 tahun 2014 Tentang Hak Cipta karena belum terpenuhinya Hak moral dan ekonomi dari penayangan ulang yang dilakukan secara berulang-ulang oleh beberapa stasiun tv kepada Warkop DKI. Seperti halnya, dari 34 film Warkop DKI hanya ada 4 film yang menghasilkan royalty karena dibeli oleh Falcon pictures dan tidak adanya aturan kewajiban Royalti perusahaan terhadap pemain film menjadikan susahnya pemain film mendapatakan royalti dari film yang dimainkan dan Belum adanya Lembaga Manajemn Kolektif pemeran Film membuat tuntutan atas Royalti terhadap Produser Film. Saran daripada penelitian ini adalah perlunya regulasi khusus berkaitan kewajiban pembagian royalti atas karya film yang diperankan para pihak yang terlibat dan membuat perjanjian tertulis yang saling mengikat tentang apa saja hak-hak yang didapatkan dan kewajiban yang harus dijalankan atas karya cipta film tersebut dan perlunya membuat Lembaga Manajemen Kolektif.
