Abstract

The Regional Representative Council of the Republic of Indonesia is a state institution that hold the position at the center of government, but represents the interests of the region and the local community in the spirit of regional autonomy. Until the current period of DPD’s existence, however questions regarding the existence of DPD are still arises, which reveals that DPD deemed to have no authority that binding in state activities as well as in the formation of laws and regulations. The problem identification is, what is the position of the Regional Representative Council according to the 1945 Constitution of the Republic of Indonesia? Then, what is the authority function and legislation role of the Regional Representative Council as regional representative institutions in the laws forming and regulations related to regional interests? The theory used is the rule of law theory, the concept of local government, and the concept of the authority function. The research method used is normative juridical. The specification of the research is descriptive analytical. The source of the data used is secondary data which supported by primary data. Data collection techniques are carried out by library research and field research. The collected data were analyzed descriptively with a qualitative data analysis approach. The results of this research about the authority function of DPD in participating in the formation of laws and regulations related to regional interests shows that DPD’s function and authority in participating in the formation of laws is not strong, because DPD’s opportunity in fighting for regional interests and aspirations is sometimes limited that caused by the interests of political parties in DPR. Hence, there is a need to strengthen constitutionally and institutionally to escalate DPD’s authority function regarding DPD participation in law formation can be accommodated properly for the benefit of the region. Conclusion regarding the position, function, and DPD’s authority as a representative of legislative institution for each region, need to be strengthen regarding to law forming, for the creation of democratic legal products in accordance with what is aspired in the context of the welfare of society. Suggestion is that the law related to the DPD, needs to be reviewed more comprehensively, both formally and materially.

Additional Information:	Dewan Perwakilan Daerah Republik Indonesia adalah suatu lembaga negara yang berkedudukan di pusat, namun merepresentasikan kepentingan daerah maupun masyarakat daerah dalam rangka semangat otonomi daerah. Namun, sampai periode keempat terbentuknya DPD saat ini, muncul pertanyaan mengenai eksistensi DPD, yang mengungkapkan bahwa DPD dianggap tidak mempunyai kewenangan yang mengikat dalam kegiatan bernegara serta dalam pembentukan peraturan perundangundangan. Adapun identifikasi masalahnya adalah, bagaimana kedudukan Dewan Perwakilan Daerah menurut Undang Undang Dasar Negara Republik Indonesia Tahun 1945 Kemudian, apa fungsi kewenangan dan peran legislasi Dewan Perwakilan Daerah sebagai lembaga perwakilan daerah dalam penyusunan pembentukan peraturan perundang-undangan terkait dengan kepentingan daerah Teori yang digunakan yaitu teori negara hukum, konsep pemerintahan daerah, dan konsep fungsi kewenangan. Metode penelitian yang digunakan adalah yuridis normatif. Spesifikasi penelitian yang digunakan yaitu deskriptif analitis. Sumber data yang digunakan yaitu data sekunder yang ditunjang oleh data primer. Teknik pengumpulan data dilakukan dengan penelitian kepustakaan dan penelitian lapangan. Data yang diperoleh dianalisis secara deskriptif dengan pendekatan analisis data kualitatif. Hasil penelitian mengenai fungsi kewenangan DPD dalam keikutsertaan pembentukan peraturan perundang-undangan terkait dengan kepentingan daerah menunjukkan bahwa fungsi maupun kewenangan DPD belum kuat dalam pembentukan peraturan perundang-undangan, sebab ruang gerak DPD dalam memperjuangkan kepentingan serta aspirasi daerah terkadang dibatasi karena kepentingan partai politik yang ada di DPR. Oleh karena itu, perlu adanya penguatan penuh secara konstitusi maupun lembaga untuk memperkuat fungsi kewenangan DPD mengenai keikutsertaannya dalam pembentukan peraturan perundang-undangan dapat terakomodir dengan baik untuk kepentingan daerah. Kesimpulan mengenai kedudukan, fungsi, serta wewenang DPD sebagai lembaga legislatif representasi dari tiap-tiap daerah, memerlukan penguatan yang lebih dalam pembentukan peraturan perundang-undangan, demi terciptanya produk hukum yang demokratis sesuai dengan apa yang dicita-citakan dalam rangka menuju kesejahteraan masyarakat. Saran yaitu UU yang berkaitan dengan DPD perlu ditinjau lebih lanjut dan komprehensif baik secara formil maupun materiil.
