Abstract

Children are the gift of their existence as a gift that must be maintained, protected, and guaranteed their rights, but the fact that many children are abandoned is evidenced from the DTKS 2020 the number of abandoned children in Indonesia is 67,368 people and the PMKS data on the category of abandoned children in Serang City is 13,860 people, it reflects the constitutional mandate contained in Article 34 Paragraph (1) of the 1945 Constitution of Indonesia does not work according to what was formulated by the founder of the nation. So that the authors identify the problem: first, how the implementation of Article 34 Paragraph (1) of the 1945 Constitution on the protection and fulfillment of the rights of abandoned children, second, how the role of Social Services Serang city in protecting and maintaining abandoned children. The theory that the author uses in analyzing this research is the theory of the rule of Law and the theory of human rights. The research method used is empirical juridical research method. The Data used are primary data and secondary data. Primary Data were obtained from field research through interviews, while secondary data were obtained from literature research. The Data has been analyzed by qualitative juridical method. The results showed: first, the role of state responsibility regarding the protection and fulfillment of the rights of abandoned children has been implemented by the Ministry of Social Affairs through assistance programs: KIP, KIS, and TASA for daily needs. Second, the role of Social Services Serang City in protecting and maintaining abandoned children is with several efforts: data collection, data collection DTKS, social services and social assistance. The conclusion of this study shows: first, the implementation of Article 34 Paragraph (1) of the 1945 Constitution on the protection of abandoned children is not optimal enough due to social assistance programs that have not been distributed properly and second, the role of Social Services Serang City in protecting and maintaining abandoned children through social rehabilitation is not optimal due to hampered factors data collection of abandoned children during PPKM. The advice given by the author maximizes the data collection system for abandoned children to be more accurate because data collection is a crucial factor.

Additional Information: Anak adalah karunia keberadaan mereka sebagai anugerah yang harus dijaga, dilindungi, serta terjamin hak-haknya namun faktanya banyak anak yang diterlantarkan dibuktikan dari DTKS 2020 jumlah anak terlantar di Indonesia sebanyak 67.368 orang dan data PMKS kategori anak terlantar di Kota Serang sebanyak 13.860 orang, hal itu mencerminkan amanat konstitusi yang tercantum dalam Pasal 34 Ayat (1) UUD NRI 1945 tidak berjalan sesuai apa yang dirumuskan oleh pendiri bangsa. Sehingga penulis mengidentifikasi masalah: Pertama, bagaimana implementasi Pasal 34 Ayat (1) UUD NRI 1945 mengenai perlindungan dan pemenuhan hak anak terlantar, Kedua, bagaimana peran Dinas Sosial Kota Serang dalam melindungi dan memelihara anak terlantar. Teori yang penulis gunakan dalam menganalisis penelitian ini adalah Teori Negara Hukum dan Teori HAM. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris. Data yang digunakan adalah data primer dan data sekunder. Data primer diperoleh dari penelitian lapangan melalui wawancara, sedangkan data sekunder diperoleh dari penelitian pustaka. Data yang telah diperoleh dianalisis dengan metode yuridis kualitatif. Hasil penelitian menunjukan: Pertama, peran tanggung jawab negara mengenai perlindungan dan pemenuhan hak anak terlantar telah diimplementasikan oleh Kementerian Sosial melalui program bantuan: KIP, KIS, dan TASA untuk kebutuhan sehari-hari. Kedua, peran Dinas Sosial Kota Serang dalam melindungi dan memelihara anak terlantar yaitu dengan beberapa upaya: pendataan, pendataan DTKS, pelayanan sosial maupun pendampingan sosial. Kesimpulan dari penelitian ini menunjukan: Pertama, implementasi Pasal 34 Ayat (1) UUD NRI 1945 mengenai perlindungan anak terlantar belum cukup optimal dikarenakan program bantuan sosial yang belum terdistribusi dengan baik dan Kedua, peran dinas sosial Kota Serang dalam melindungi dan memelihara anak terlantar melalui rehabilitasi sosial belum optimal dikarenakan terhambat faktor pendataan anak terlantar pada masa PPKM. Saran yang diberikan penulis memaksimalkan sistem pendataan anak terlantar agar lebih akurat karna pendataan merupakan faktor yang krusial.
