Abstract

ABSTRAK PELAKSANAAN PEMBATASAN IMPOR BARANG BERDASARKAN WTO AGREEMENT ON IMPORT LICENSING PROCEDURE (Studi Kasus Pembatasan Impor Hortikultura Oleh Indonesia) Oleh, INDRA MIDIAN 1111143105 Prinsip Non Diskriminasi dalam WTO menyatakan secara tegas mengenai larangan perlakuan diskriminatif, hal ini dikarenakan diskriminasi merupakan bentuk awal dari suatu tindakan Proteksionisme. Dalam hal ini Indonesia mengeluarkan suatu kebijakan yaitu Permentan Nomor 24 Tahun 2018 dan Permendag Nomor 64 Tahun 2018 tentang Rekomendasi Impor Produk Hortikultura (RIPH) dan Permentan Nomor 23 Tahun 2018 serta Permendag Nomor 65 tentang hewan dan produk hewan. Tindakan Indonesia digugat oleh Amerika Serikat dan New Zealand di World Trade Organization (WTO). Gugatan tersebut terungkap dari hasil laporan Badan Penyelesaian Sengketa di bawah WTO yaitu Dispute Settlement Body tertanggal 18 Januari 2019 dengan judul Indonesia-Importation of Horticultura Products, Animals, And Animals Products: Status Report Regarding Implementation of the DSB Recommendations and Rulings by Indonesia. Maka penulis tertarik meneliti tentang : “Pelaksanaan Pembatasan Impor Barang Berdasarkan WTO Agreement on Import Licensing Procedure” (Studi Kasus Pembatasan Impor hortikultura oleh Indonesia) ? Penelitian ini menggunakan metode penelitian yuridis normatif yang didukung oleh pendekatan kualitatif. Spesifikasi penelitian bersifat Deskriptif Analitis dengan menyajikan analisa terhadap identifikasi masalah berdasarkan data sekunder berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Kemudian di analisis secara yuridis kualitatif. Hasil penelitian dapat dikatakan Indonesia masih belum menerapkan seluruh ketentuan Agreement on Import Licensing Procedures, Khususnya dibidang pempublikasian segala informasi terkait kegiatan Impor. Tetapi, Indonesia telah berhasil menyesuaikan ketentuan peraturan pembatasan impor barangnya dengan prinsip WTO, karena dalam peraturannya Indonesia tidak mengatur mengenai jumlah kuota yang dapat diimpor ke Indonesia. Indonesia hanya mengatur terkait prosedur administratif saja.

Additional Information:	The Non-Discrimination Principle in the WTO states explicitly about the prohibition of discriminatory treatment, this is because discrimination is the initial form of an act of Protectionism. In this case, Indonesia issued a policy, namely Minister of Agriculture Number 24 of 2018 and Minister of Trade Number 64 of 2018 concerning Recommendations for the Import of Horticultural Products (RIPH) and Minister of Agriculture Number 23 of 2018 and Minister of Trade Regulation Number 65 concerning animals and animal products. Indonesia's actions were sued by the United States and New Zealand at the World Trade Organization (WTO). The lawsuit was revealed from the results of the report of the Dispute Settlement Body under the WTO, namely the Dispute Settlement Body dated January 18, 2019 with the title Indonesia-Importation of Horticultural Products, Animals, And Animals Products: Status Report Regarding Implementation of the DSB Recommendations and Rulings by Indonesia. So the author is interested in researching about: "Implementation of Restrictions on Import of Goods Based on the WTO Agreement on Import Licensing Procedure" (Case Study of Restrictions on Horticultural Imports by Indonesia)? This study uses a normative juridical research method which is supported by a qualitative approach. The research specification is descriptive analytical by presenting an analysis of problem identification based on secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. Then in a qualitative juridical analysis. The results of the research can be said that Indonesia still has not implemented all the provisions of the Agreement on Import Licensing Procedures, especially in the field of publishing all information related to import activities. However, Indonesia has succeeded in adapting the provisions of the regulations for restricting the import of its goods to the WTO principles, because in its regulations Indonesia does not regulate the amount of quota that can be imported into Indonesia. Indonesia only regulates administrative procedures.
